What penalties can a person face if they are found driving a vehicle without the Interlock Ignition Device.
My son is a week and a half shy of completing his time with the IID. I believe he was in this for at least 18 months. The device is installed in the vehicle he uses for work, not in his truck. He drove his truck to Lowes, no IID in this vehicle. Received a citation and so forth. Was pulled over for answering a cell (delete expletive here). His time with the interlock has been satisfactory, with the exception of two malfunctions for him not operating it correctly, no alcohol issues in these instances. Operator error basically. He was told this is an MVA issue. All of this resulted from his second DUI. He has successfully completed ALL requirements related to this offense. Probation, classes, etc. What penalties might he be looking at. Thank you so much for your time.
More Interlock time and possible violation of probation which may carry jail time plus violating a license restriction...
I received a Pbj for a dui in Maryland. I will be off probation in May. Is it true that a Pbj for dui can no longer be expunged?
See question above
Yes, a PBJ for a DUI cannot be expunged in Maryland.
What options do I have to get my drivers license reinstated?
Back in the 90's I was involved in an accident without insurance. I was broadsided but there were no injuries. I was not charged in the accident. I missed my court date and a judgement was filed against me. I began making payments to keep my Maryland drivers license current. I became ill and was unable to work any longer. My last payments were made in 2008. My drivers license was suspended and I haven't driven since. I have been unable to get to my doctors appointments or to the grocery store on occasion. I have been making attempts to contact the lawyer who holds the judgement and he fails to answer or return my phone calls. What legal steps do I have or what can I do to reinstate my driving privilege.
Judgments generally only last 12 years. You may be able to file a motion to strike the judgment and release your...
Can I obtain discovery for my own DUI case on my own, or do I have to retain a lawyer to obtain discovery?
I am looking to hire a lawyer for an upcoming DUI case I'm involved in. My question really is, can I wait for a perspective lawyer to obtain discovery on my case before I retain him, or is it possible to obtain discovery on my own, so that as I am shopping for a lawyer, I can make the best decision for my specific case?
Worst decision you could make would be to conduct discovery yourself. Kind of like running the first 50 yards of a...
