I had a DWI almost 2 years ago, reapplied for my license a year ago, had to pay 250 DRA and took the 10 week driver alcohol education classes in May of this year, the dmv is dragging their feet on releasing my driving privileges, they won't tell me why, can I sue them or can lawyer help me get my license back and my cdl class A as well, I don't know where to go with this and what to do next
It is not obvious why the DMV is dragging their feet on this, but it certainly is worth looking into. Your best bet...
I have a dwai and a dwi in ny over a five year period. In fla i then got a dwi reduced to reckless driving.
Needless to say, i no longer drink. My problem is that a dwai here in ny is a traffic infarction and not a criminal charge. It is the same as a 0.4 breath test or any impairment. Fla dmv is using this dwai and counting it as a first offense. Can they do this? thank you
I am sorry to hear about your situation. You may wish to repost this in the Fl. forum. I wish you the best of luck....
Conditional license from DMV?
I was recently convicted of DWAI in New York. I also attended a hearing at the DMV because I refused to take the breathalyzer when I was arrested. After the hearing, the DMV took my license away for a year based on my refusal. Can I get a conditional license? The woman judge hearing the case was really mean.
You can apply for the conditional license in light of the plea.
Can I apply for CPA exam with DWI on my record?
I would like to apply for CPA exam. I had a DWI in 2009. Can this disqualify me from exam?
From the exam, not likely but call an attorney who handles professional licensing.

I am in probation in ny for a 2nd dwi while on probation I was having medical issues and decided to drive myself to the store to get meds, before I got there u was pulled over and given 5 test none came up with a difinitive result, then I was told I can drive my car home since it was 6 blocks down the street which I did and the cop followed.. then after I got into the car and taken to the station about 1 1/2 hrs later I ws giving the test wich read .11 I told text officer to take my blood since I'm sure it was false reading due to acid reflux. Now I was told by my probation officer that he filled for vop.
Can a police officer do what you described? Apparently yes, because you experienced it. Should a police officer allow a...

Can I sue the city following a DWI case they dropped against me?
I was arrested for DWI in August of 2014. For numerous reasons including medications I was taking the breathalyzer registered a false result (.087) I was concerned the medications would impair the accuracy and asked repeatedly to speak to my attorney but the police officers refused to allow me to. At the same time, my attorney (my father) was on the phone with my sister (my passenger), and my sister was trying to get the police officers to let him speak to me. My field sobriety test was off the charts perfection. I was not intoxicated. It was a DWI checkpoint and the cop admitted on the stand he flagged me to pull over because I had dilated pupils, which was a result of my medications, and not a criteria they are trained to look for during checkpoint stops. He also admitted I showed zero signs of impairment. However I was arrested and in jail for close to 24 hours. I had to go to the court house once a month for close to a year. I spent about $25,000 on a defense attorney. In July of 2015 the judge ruled that the breathalyzer result should be suppressed. Left with no case, the city dropped the case in September 2015. Is there any legal action I can take?
It is highly unlikely. If police had a reason to arrest you, probable cause, they were doing their job honestly. You...
