I was arrested at 7:30 AM on 2/13/16 after having slept in my car after the bar closed down. I drove out of the parking lot up the road 500 yards and turned into the Hotel/Casino to get a room since it was freezing in my car. As I pulled into the parking lot and found a stall, two cop cars turned on their lights. I had been drinking heavily the night before, the office said he smelled it on my breath and found the empty 40 oz beer bottle in my car that I had drank before going into the bar.
They cuffed me and put me in their car and hauled me to their police station where I did the breath test twice. The first time it was .112 and the officer had me sit a minute and rinse my mouth out with a cup of water and took the test again, this time .085. He said that would be the one that he would file. They took me 90 miles to Elko Co jail where they booked me and put me in a cement room. About 5:30ish pm I finally made bail after I agreed to pay the full amount of the bond, $1050 + costs= $1280 which i paid by debit card. My Husband was arrested on a bench warrant no bail for missing his sentenced time for his DUI. How long till he sees a judge?
I was told it could be two weeks. He got a no bail bench warrant and they say there is nothing i can do. Can they really keep him without seeing a judge for two weeks? We made several attempts to contact the judge to arrange a new time and talk to him about why he missed and never heard anything until the cops showed up to arrest him a month later.
Your lawyer should be able to file a motion to place on calendar to post bond/OR release upon 2 days' notice.

Was arrested in June 2012 for driving on suspended license, dui, felony possession of marijuana with intent... was released on ror...since then the court has not filed charges and keeps changing to court date...Is this normal and is there a time frame for them to file ...Being from out of state and have had past dealings with the court this seems abnormal...

Looking for second opinion... Plea bargain for DUI & Possession - not for sale charges
I have been offered a plea bargain and here is the gist of it: I have to plead guilty to the DUI, I have to plead guilty to the felony drug possession charge (under a gram of cocaine) . FYI, I was under the influence of alcohol, not the cocaine. I have to apply to drug court diversion program. If I am accepted, the felony charge will be ... dropped? expunged? (not quite sure on which) If I am not accepted, I will be required to plead guilty to a conspiracy to possess a controlled substance charge which is a gross misdemeanor. There is no guarantee on the sentencing for either charge it only says that the state will remain silent. I am worried I will not be accepted to drug court, should I try for a better plea agreement, or will this likely be my best option?

How likely am I likely to be charged with a marijuana DUI?
I took a couple tokes of low grade marijuana an hour before work. I have a medicinal card. I was on my way home from work (6 hour shift) and I got pulled over for talking on my cell phone. The cop asked where the weed was and I gave it to him with my pipe. I didn't have my card on me. He gave me field sobriety tests I did good on the eye tests but poorly on the others. I weigh 260 and would not perform well sober. I spent the last three days in court and have an arraignment coming up for DUI.

I had a dwai in colorado back in 2009. I would like to work with a driving company out of nevada but they go back 7 years and denied my application. Its a much lesser charge of 500.00 dollar fine vs a dui which is 10,000.00
