Why when my son has 1 OWI in Wisc is his attorney telling him he will be serving 3-6 months in jail, have to put a device in car
He had a DUI in Illinois a year ago, and was pulled over in Wisc, submitted to Breathalyzer on scene. He has been diagnosed in the past as bipolar, suicidal, has been in and out of rehabs since finding his dad passed away and the anniversary of this unfortunately set him off. He has been wearing the ankle bracelet for 90 days with no issue, and his public defender is telling him he will be serving 3-6 months in jail?
An ignition interlock device is required on a second offense. And a 2nd offense in Milwaukee County (assuming that's...
Can my dui be dismissed ?
Officer sent letter in mail stating that he had voided my dui citiation because the ‘citation was issued in error’ because he initially put 346.63(2) then changed it to 346.63(2)(a)(3) after the blood test came back. Thank you
Not only is this not a reason to dismiss the case, it is required by law for the citation to be amended when the test...
Will catching a misdemeanor case while on probation violate my probation?
My brother is on probation for driving with out a licence and has been apprehended once again for the same offense. Seeing that it's a misdemeanor shouldn't his probation be reinstated?
People on probation for misdemeanors do not get to commit another free misdemeanor before getting revoked.
What type of letter do I send to reopen a OWI traffic case?
I was pulled over for exceeding the speed limit. I was given a field sobriety test and past all (breathalyzer was negative, walked straight line, etc) I was taken to a hospital and they drew blood where I tested positive for THC. I was released with no ticket and no information about the stop. This was in Wisconsin. Since then I moved back to Illinois to find out that I missed court dates I was never notified until afterwards. I was charged guilty for an OWI and speeding even though I was never notified of any cort dates or given the chance to defend myself. They say I have to take an evaluation plus classes and have to have a device placed on my vehicle for 12 months. I would like to reopen this case to state my case.
It is impossible to transfer a criminal case from one state to another for any reason other than supervision. In other...
Can my 5th Owi be dismissed because someone gave a inaccurate description of me?
I was drunk and my car broke down, I got out of my car and started walking around a subdivision looking for help, someone said they seen me driving my car and called police, the discription of me was completely wrong and I was only found prowling but I was arrested for owi 5th, I wasn't in my car, I didn't refuse the tests, I just told police to do what they need to do......eventually they got my b.a.c. through a blood draw.......is it possible for this to be dropped?
If you are planning on fighting this, you need to hire a lawyer or apply for a public defender if you cannot afford to...
Will my neighbor go to prison?
Our upstairs neighbor has recently been arrested and bailed on a 4th OWI charge. His record also contains non-serious felonies (operating w/o owners consent, battery by prisoner) and various misdemeanors. After the 4th OWI, he was put on a SCRAM bracelet as bail. He recently cut off the bracelet, threatened his and his wife's life, took her car w/o consent, and totaled it. As of this morning, they have not located him but he has been in contact with his wife. She has mentioned that he was originally being charged with another operating w/o consent, but that charge is now dropped. Basically, we are wondering what will happen once found. We are hoping it is substantial jail time because we are tired of him causing so much turmoil in our neighborhood (many altercations including breaking another neighbor's sliding door with a pipe wrench) and the general disruption from his intoxication. If his wife is able to bail him out and bring him home again, we will likely look into breaking our lease to move. Any insight is very appreciated, thank you.
While it is impossible to tell for sure, he certainly would appear to have at least implicitly reserved his place in...
Received a notice from charging officer that he had voided my citation of dui because it didn’t match the drugs in my system &
Reissued me another dui citation 7 mos later. I’m assuming because there was an error on his part on the original citation. I had no alcohol and only one prescription drug in my system. I was in an accident and they took my blood. My court date is Nov. 1, I just received this letter. Thank you.
There is no question here. It is common for additional or amended citations to be issued once the blood test results...
