Any statute of limitations on moving violations and or dui (marijuana) in Illinois?
Accident occurred in March. No tickets issued. Over three months later, failure to reduce speed to avoid an accident, and improper lane usage tickets issued. Now seven months later, taking about charging with dui (marijuana). Any chance of beating it?
Not on those grounds alone, no. An attorney might be able to help you find some better grounds. If you don't have an...
Conviction of a dui in 2006, driving on suspended 4 times, and driving on revoked in an accident in 2010 how can I get license?
Do I have to get the breathalyzer in my car and drive on a restricted or can I get fully reinstated after paying everything in full, or can I pull my dui case back up in court to show that I completed all classes and paid all fines and get my license reinstated that way?
I have a couple of thoughts. First, if you had an attorney on your prior case(s), I suggest giving them a call, as they...
Is there a difference in DUI case "dismissed vs not convicted" and "reckless driving vs negligible driving"?
Want to know what is the difference between "not convicted" and "case dismissed" if any, and reckless driving vs negligible driving"? Thank you
Dismissed - no trial or plea. Not convicted - plea or trial. Reckless negligent (not negligible) are different...
If found not guilty of DUI. if an application asks "have u ever been cited for a DUI?" Do i put yes or no? What about expunge?
Got a dui for marijuana....went to court...got it dismissed because I had no weed on me, the cop wasnt certified to give the test, and pulled me over out of jurisdiction...
I do not know of any application that asks whether someone has been 'cited' for a DUI. In Illinois it is illegal for an...
I'm on felony probation. Cop let me go on a DUI last night. Can my PO run my name and see that i was pulled over?
The cop knew someone in my family and was really cool about it. He followed me back to this girls. He didn't even mention the fact that i'm on probation, just wanted to make sure i was safe and didn't have drugs. When my name gets ran by the police does it automatically get sent over to my PO stating what happened. I have to see him tomorrow morning. Should i even bring up that i got pulled over?
First let me go on record that I usually am annoyed by my fellow attorney's who immediately tell any person posting on...
Drilling reservist with DUI on drill weekend
I am a drilling reservist with 3 years left on my contract. I got a DUI over a drill weekend couple of weeks ago. After couple of hours at the police station, I was freed and I went to drill not wanting to miss it. I have a court date next month and if it doesn't go the way I want it to be, I will get court supervision/license suspension for 6 months. I am planning on getting my record expunged afterward. The arresting officer told me that my command will not find out about this because it is between "me and him". I'm not sure what he means by this. Will my command find out?
This is a very dangerous game you are playing. I have represented military clients on DUIs over the years. I have had...
Do out of state DUIs carry over?
So, my girlfriend was arrested yesterday afternoon for driving while under the influence in Rockford, IL. This is her 3rd DUI, but it is her first in the state of Illinois. She had gotten 2 DUIs almost back to back in Michigan about 2 years ago, but was able to walk away after 10 days in jail and without probation. To date, she owes the state about $6,000, and technically has a warrant out for her arrest in Michigan due to unpaid fines. I'm curious if the DUIs will carry over, because right now her bond is set at $300, and that seems awfully low for someone with her DUI history. Isn't a 3rd DUI supposed to be a felony, anyway? She had gotten into an argument with someone and fallen asleep in the car (which just so happened to be in the middle of a parking lot). Someone noticed her passed out in the car and called the police, who then knocked on her window and proceeded to question her. They got her with 5 charges: DUI ALCOHOL/INTOX COMPOUND/DRUG; POSSESS DRUG PARAPHERNALIA; POSSESS CANNABIS 2.5-10 GRAMS; DRVNG UNDR INFLU/BAC 0.08; TRANSP/CARRY ALC LIQ/DRIVER. I know she had a bunch of opened containers and cans in the car. What is likely to happen if she is not bonded out?
Convictions from other states carry over to other states. You know she needs to get a dui attorney, help her do that....
