1) Do the district court fines need to be paid in full prior to filing petition?
State of Maine: OUI 1st offense non-aggravated. Will be filing petition for ignition interlock. Payment plan established with district court to pay fines. 1) Do the district court fines need to be paid in full prior to filing petition? 2) Does the licence reinstatement fee/form need to be filed with the petition?
The Fine does not have to be paid before you are allowed to petition. However, you must pay your fine as ordered or...
My husband died 9/3/13 from a fall. He was legally intoxicated. Life insurance didn't pay pay, is it worth using to collect?
It was a $300,000 policy offer by one of our credit cards. I didn't know he was an alcoholic when I took this accident policy. Now they say it's excluded because of his intoxication. This all assumes that it hasn't been too long to try. I got the policy because I am already disabled and getting worse.
$300k, I certainly think it was worth my time to try to fight it.
How would I go about having my OUI in Maine taken off my record
How would I go about having my OUI in Maine taken off my record? It's been over 2 years. (If you look at all the facts I wasn't even driving I took the blame) I went back to school. I received 2 degrees now I have a great job in an environmental lab. (Mind you I'm honestly telling you I never drove and this was my first arrest ever) I would like to travel to Canada next summer but I'm not allowed with this.
99% of the time, the facts of your case do not matter after you are found or plead guilty. The only time the facts...
Bloodshot eyes grounds for arrest?
I was arrested last night after a cop approached the parked (idling) car I was sitting in and began questioning me on my activities that evening. I am an adult under the legal drinking age and admitting to consuming one beer a few hours ago. The cop used the grounds that my eyes were bloodshot to administer a field sobriety test, which I passed. I was then placed under arrest for "Operating without a license" and taken to the country jail. I was fully cooperative with the officer. I ended up blowing a .04 on the breathalyzer test administered at the jail. I posted bail and left. Are the grounds on which the officer arrested me legitimate, and as this is my first offense is there any chance of the charges being dropped?
An admission of consuming alcohol, the odor of alcohol, and bloodshot eyes are going to be enough to at least detain...
Will I face criminal punishment from my home state of Arizona for a first OUI in Maine?
I was visiting family in Maine when I was arrested for operating under the influence. If found guilty in Maine, will I have to face AZ punishment (fines, jail, etc.) when I return home.
AZ will not sentence you to fines or jail for a Maine OUI. They will, however, suspend your license upon notice of...
Should I contest a speeding ticket if I already have a DUI reduced to reckless driving in the last year?
I was stopped for speeding. 68 in 50. When officer approached, I did admit that I was going "a little" too fast, but don't think it was that much over.
Sure you should. Just because you were arrested for DUI a year ago does not mean there is no chance for a good outcome...
