Can an expunged record of a first and second DUI offense be used in a custody hearing???

My newborn was tested positive in her stool for marijuana. However I am negative. I have to take a drug test in the morning, which I have no problem with. I will do anything to keep my kids. How long will this case most likely last when my test comes back negative?

I took my annual urine test in North Dakota, i went to a clinic, took the test, and went back to work. The medical review officer called saying i failed for morphine. I never took anything. I got paid for the labs to retest the sample and a week later they called back saying the results were the same. I went home then had a hair test taken. I passed the hair test which is more accurate and goes back farther, I've lost my job which i've had for over 4 years and this looks extremely bad on me. I did nothing wrong, never took anything. Do I have a case for restitution of damages for false positive drug test?
I was a resident in a sober living house and was given a 12 panel drug test. I tested positive for 2 drugs I had not taken in many months. I disputed the results asking for a confirmation test. The house refused to confirm the test and expelled me and called my employer having me terminated. The drug test was at 10:30 am. I rushed to ER explaining what happened and they agreed to retest and send for confirmation test. I was viewed during my retest at hospital and I tested positive again but the hospital then sent it to a lab and it was confirmed as a false positive due to an over-the-counter drug. Can I sue for my job loss, home loss, damage to reputation, pain and suffering?
Not likely to be able to sue for a job loss since in most states you are an at will employee and can be terminated...
How would you answer this question about DUI charges on employment application?
2 years ago I was arrested for DUI and my case was dismissed after pre-trial diversion. I have done an internet background check and it hasn't shown up but I'm sure it will on a more extensive FBI check. But the wording of this question on an application has me confused. It reads: "Have you ever been charged with driving under the influence of alcohol or a controlled substance?" I have to answer "yes" because I was arrested even though I wasn't convicted?
