How to explain my criminal conviction on employment application if business perform a 7 yr background check?
I was convicted of a felony theft by unlawful taking 3rd degree in New Jersey in April 2003 and completed probation in 2006. This is my only conviction and have changed my life around since it happened. I am working as a contractor at a fortune 500 company as IT support and have passed the background check with no issues. Now I am being considered to be converted as a perm employee. I know that I will have to do another background check which goes back 7 yrs which states in their policy. I have no issues disclosing on the application and will be honest. How do I explain my conviction when asked: "Have you been convicted of a felony or misdemeanor?" and will I be considered for hiring?
If part of the hiring process is to ask that question, you must be honest. Since you are so close to the 7 year mark...
How does dui probation in Dupage county work?
Last month I was sentenced to 24 months of probation for my second dui. The judge had told me that I will be randomly tested for alcohol via ETG tests twice a month. My question is will the probation department also test me for drugs (Marijuana) even though the court order only mentions that i will be tested for alcohol?
Yes... it's very likely that you'll be tested for alcohol, marijuana and numerous other drugs while in probation. Your...
Can I move out of the country with court supervision DUI?
I was planning on moving to Korea in the coming month, but since I just recently got arrested for a DUI, it will not happen as quickly as I thought. I still would like to move there though to teach, and was wondering the chances of me being able to do so while on court supervision. I have not been sentenced yet, but my attorney advised me that the chances of me getting this sentencing due to my prior background is very high. I plan on taking all of the classes needed, as well as anything else I must do before the move. So is this possible?
Some countries will not allow you to enter with court supervision on a case for at least 10 years. Canada is one of...
What happens if I don't show up for my final DUI hearing?
I got a DUI in DuPage County, Illinois awhile back. I was given supervision but was unable to complete all of my community service on time per my sentence. The SA filed a Petition to Revoke and I was given more time to complete the community service. I have now completed it and all of the requirements. The Probation department has confirmed receipt of everything. However, I have to be out of town for my final date, which is next week. I didn't know this until yesterday. Do I have any options in terms of continuing it for even 4 or 5 days? What happens if I don't show despite completing all of the requirements? Thanks in advance.
You don't tell us why you have to be out of town. If it's work related, that's a good reason. If it's purely pleasure,...
Can I get a DUI record expunged even though I plead guilty and ended up with court supervision for reckless driving?
Had a background check done recently and the verdict for the dui and reckless driving came back as dismissal.
Possibly. The following is directly from the OSAD's website on expungements & sealing. YOUR CASE MAY QUALIFY for...
How can I travel with Extended conditional residence If i am in court Supervision for DUI ?
I am in the process of removing the conditions in my green card after 2 years of marriage. I recieved a letter that extends my GC for another year. My issue is that I recieved Court Supervision for a DUI for one year. Will it be a problem for USCIS ? ( I have permission from The DUI court but want to be safe and know if any other process is necessary) THANKS
Your travel question has nothing to do with US immigration law. From immigraiton law standpoint you can travel with an...
I failed one drug test after passing about 20. My po loves me and says ill be off in august. What are the chances?
I have completed all 3s counseling and then some, completed all community service and paid nearly all my fines and kept up to date with AA meetings. I failed one test in april for amphetamines which was actually false positive but she said she would give be 6 weeks intensive drug testing in which i passed them all. I have 2 more to pass before august. Then im off august third. My po said i am on track to get of in august if i pass all my tests and continue work and school. I have all the right things on my side. Except for 1 failed test and i came clean with the officer and she said we will keep this at the probation level and as long as you never fail again your in the clear, however i am nervous there will be some repurcussion. I mean my po said ill be off in august but who knows what the prosecutor will say, they may hold it against me, give me an extra fine, 2 days in jail or worse extend my probation even though ive done the right things. What would you think would happen? She didnt violate me, i think i would have had a court date for that.
Most of the time a Judge will listen to a PO above all. If your PO is on your side, you should be fine but you need to...
