What should I do? If they win adoption can I appeal it? If they win will I ever have the chance to get them back? Please help :(
In February of 2012 I sent my children to West Virginia from Alabama to temporarily stay with my exs brother and wife (JJ & Danielle.) At the time I was trying to relocate to West Virginia. My children's father went to jail in Oct 2011 & was sentenced to 17 1/2 years. I did have a drug problem that I kicked on my own. In April 2011 I took an overdose and was in the hospital on life support almost 2 weeks. I was and still am struggling in some aspects of my life. I called JJ & Danielle & told them I was coming to get the kids in May & the very same night I was arrested for a DUI. They then went and got emergency custody, so when I called again a few days later & told them I was coming, they informed me not to show up they had custody. Now they are pushing for forced adoption on the 29th.

DUI erroneously reported from another state, do we let it go, fight it or try for interlock
My son is a WV resident, he was pulled over in Ohio they requested a urine sample. After 3 separate court dates for continuance (because the urine results were not back yet) my son finally pled no contest per his public defenders advise. In Ohio, if your urine is positive for more than 10 nano grams of marijuana it is considered OVI regardless of if he was impaired at the time. He knew it would be positive, even though his actual results were not back yet. Yesterday we received notice from WV that his license are suspended for 90 days because of a DUI in Ohio of less than .15. I spoke with WV DMV today they said that Ohio reported it as an alcohol DUI even though there was no alcohol it was marijuana.
Do we accept the alcohol charge and try for the interlock program which will grant him driving privileges, or do we fight this since it is not true that it was alcohol related. My problem with fighting it for a drug related then there are no driving privileges granted until the 90 days suspension is fulfilled. Is there a possibility we could get the whole suspension "thrown out" for WV being that it was erroneously reported as alcohol when in fact there was no alcohol involved?
You should speak with experienced DUI lawyers from OH and WV to figure out your best chances, since DUI laws are state...
How do I get permission to drive to work, counseling NA following OVI
I pled guilty to OVI in Ohio, even though I was not impaired at the time,I had marijuana in my system from prior use, under Ohio law that means I'm guilty of OVI. I am a West Virginia resident, WV does not have this law that im aware of. I just received a notice from WV that my driver's license is suspended due to the Ohio charge. I am currently court ordered drug counseling, NA, must keep full time job etc. for a separate charge in WV for possession of marijuana. If I can't fulfill those I will go to prison. What are my options for getting restricted driving privileges to get back and forth to work, counseling etc. I know WV does not acknowledge restricted privileges but Ohio does. Do I try to get permission to drive via WV or Ohio since that's were my charges are coming from. WV will allow a blow n go but only if my offense was alcohol related (it was not). All I need is permission to drive to and from work, drug counseling and NA meetings.
You can certainly get privileges from the Ohio court, which will clear up the issue as far as Ohio is concerned. The...
My friend was on house arrest for a 3rd offense DUI, he's back in jail because of a "Pretrial Misdemeanor" What does that mean?
A friend of mine was placed on house arrest after receiving his 3rd offense DUI. I believe he got sentenced to 2 or 2 1/2 years. However, I haven't been able to get ahold of him for a while now, so I ended up checking the current inmates for our state (West Virginia) online and go figure, there he was! It says he was booked on 3/2/16, so he's been in there over a month, his bail is set at $1,000, and above his name it says PTM - Pretrial Misdemeanor. What does that mean? Did he violate his house arrest or is this a whole new charge?
Those codes on the jail website are usually incorrect, but not always. If your friend is in jail, it is most likely...
Can someone please help me get my license and all my money back from these bogus charges
This still contains to the first situation about the DUI case I got screwed over on. If someone would please contact me or give me a contact number I can give a better statement of my situation. I appealed DMV case, went to court at DMV, officer shows up at hearing lying and when I called him on it he jumped up out of his chair and said, im done here. Through his folder on the table and walked out of the court room and left in his patrol car. We was only about 10-15 minutes into the hearing when he went storming out threatening me at the same time and they didnt even throw it out over his actions they found me guilty 3 months later and took my license. Now after going through everything they ask me to do I violated their program because I drove a frinds car 1/2 a mile into town to help out another friend and got pulled over and arrested for not having the interlock device in that vehichle. If judge Jenkins from the Preston County WV court house is correct I shouldnt have been put on yhe program to begain with because the DMV illegally revoked my license in the first place because I represented myself in their court room instead of hiring a lawyer. Please help me and be rewarded
