Can you be charged with a DUI if YOu was never seen driving? I was inside a house where My friend ran the car in a ditch ...
Me and my friend Mike was leaving from my boyfriends house it was 6:45 am, Mike was driving. My boyfriend gave Mike the keys because I was still drunk from the night before. It was raining real hard so we stoped to turn around plus it was still dark when we went to turn around in a driveway we ran into a ditch and got stuck. Well Mike my friend left to call someone to pull the truck out of the ditch and I didnt want to leave the truck becaue it was My boyfriends truck.well the peoples house I was at, invited me in because it was raining then the cops showed up they saw the truck stuck in the ditch....They came to the door of the house I was at and asked who it belonged to, I said me its my boyfriends truck. They ask if I had been drinking then they gave me a breathalyzer and charged me with a DUI....But they never saw me driving the truck My friend was driving not me But they still charged me with it because I was the only one there. Mike had already left to get help...

Can I get approved again for DACA if I got a DUI?
I recently got a DUI this April and have yet to get convicted. It isn't looking great and my DACA expires in November. I don't have any prior run ins with the law other than a minor traffic incident that got reduced. I've been approved twice and am worried I won't get approved a third time. I pay my taxes and do everything I need to do it was one stupid mistake that I regret. I planned on returning to school this fall. Any advice?
DACA will not be approved with a DUI conviction. Contact a criminal defense attorney & US immigration attorney for...
Can I move interstate from Oklahoma to North Carolina after a first time DUI plead with my interlock in place?
I was arrested for DUI in Arkansas in May. Pled and given 6 months of interlock, fines, classes. I live in Oklahoma. These restrictions apply there as well. I have a job offer in NC and would like to move. I am more than fine with keeping the interlock as long as required. Can this be done? How do I make it happen correctly?
Yes, you probably can move. The only thing that would legally stand in your way is if there is some sort of probation...
Got a DUI in NC about 10yrs ago. Medical issues forced a move to NY, so its still out there, unresolved. Can this be remedied?
I don't drink, ever? I have a seizure disorder and a severe ptsd disorder that both cause blackouts and actions unintended. I initially plead guilty thinking I could explain to the judge the circumstances, as I had no recollection of drinking or otherwise. One minute I am in my house recoveringfrom neck surgery, the next memory is awakening in the ER handcuffed to the bed. So, by my own ignorance of court process I now had a misdemeanor and about to be put into the NC probation system. Initially, I hired a lawyer to contest it and he saw a good case since I had no prior record and documented history of dissociative behavior making it basically "not guilty by reason of mental defect" or something to that effect. Housing and medical issues forced a move to ny. My intention was to go back for the court date and fix this. Disability and money made it impossible to return to NC for court dates. I figure I might have probation violations, bench warrants or more. Can I be extradited? How do i fix this? Havent driven since
Contact a local defense attorney. You will need someone who can look up the current status of the case and advise you...
What are a persons rights at dui checkpoints
I have always been curious about an individuals rights at dui checkpoints... I've read before that when stopped by an officer that you don't even have to roll your window down as long as you place your I'd and registration in a bag out the top of it. And then I recently just watched this video: https://m.youtube.com/watch? time_continue=319&v=tLnhSl1ajyc ..... so what are citizens rights at dui checkpoints? What are we required to do and cooperate with? And also does this guy in the video have any recourse for the dog scratching his car? And do we really have any rights at all when they can simply exagerate a dogs reaction and say that he hit on the car?
You have a lot of questions but the easiest answer is that you simply have the right to refuse all field sobriety tests....
I was arrested with a DWI and blew a .15. Would I be allowed to move from the country for a year?
I was recently arrested for a DWI and blew a .15. Unfortunately this was while out celebrating my girlfriend getting a job offer in the Cayman Islands for a year at a bar 1/2 mile from my house. We have been discussing me going with her for a year since I can work remotely. If convicted I'm expecting 24-48 hours of community service, alcohol abuse classes, and the loss of my drivers license for a year (or if I stay here a provisional license meeting certain criteria and interlock). Is this even a possibility for me to move now? I of course feel I'd be required to fly back to be at all my mandated court dates where my presence is mandatory. And if convicted would I need to stay here to complete my community service and alcohol classes in a timely manner? Or would the fact that I'm living in a different country give me some time to complete these obligations. Nonetheless, due to my idiocy of not taking an uber home or even walking such a close distance my life has become a disaster. I'm not trying to run from the court or my sentence it's just an opportunity we've had and I'm afraid I may of ruined it. Any help or advice is more than appreciated.
Several options to consider to accomplish what you want. You might even have a case with solid defenses.
