I have been on probation for a felony DUI in Alaska for 2.5 years with a minor PTRP with no new charge and only 6 months remaining on probation. Can I petition the court to reduce my charge to a Misdemeanor?
This would require an attorney from your state. In some states, such a petition is possible, but the prosecutor...
If a person was arrested for a DWI and failed to appear both times and skipped out on both bail amounts what is the consequences
Someone I know was arrested for a DWI in 2007 and bailed out and then left state Texas without going to court. They put a warrant out on him and then in 2013 he went back to Texas turned himself in and bailed out on a surety bond. Again he fail to appear and now has another warrant. What are the legal consequences when this happens?
Nothing good. I would say he should contact legal counsel but it is apparent he has no intent on dealing with his...
I was given a field sobriety test after being outside in below 20 degree temp for over a half hour with only socks and t shirt
on I believe I was hypothermic I failed the test and was given a breathilisore I think both test should be thrown out any opinions or answers
More would need to be discussed with an attorney before they could provide you any opinions. I would suggest...
I was charged with a first DUI in Alaska on 10/1/13. My license was revoked for 90 days. I also have 3 days jail (remanded to 1/15/14), SR22 and ignition interlock requirement, alcohol classes and a fine. After 90 days, if I have not completed my other requirements yet, can I get my license reinstated?
You have to show you are in compliance with your ASAP (Alcohol Safety Action Program) requirements, which usually means...
I just got 2 years probation in Iowa for a second dui that was 12 years old. I left the state as i know longer live there.
What should I do? I contacted the probation officer and she said to come back. I explained that this was from 12 years ago and I know longer lived in Iowa. She said that one of the conditions was not to leave the state. I served seven days in jail and as soon as i got out i left. The dmv revoked my license 12 years ago so there penalty has already been enforced and i have a clear driving record. I don't want to be looking over my shoulder.
This depends on Iowa law, not Alaska law. And, your facts are confusing to me. If your probation was for 2 years and...

Can the military seperate me under Chapter 14-12C for a DUI charge that has not been adjudicated in civilan court?
I got charged with a DUI in the middle of October. I plead not guilty because the story that the cop had made no sense. According to him I blew a .075 BrAC on a PBT. Then less than 15 minutes later, I blew a .087 BrAC on the Datamaster DMT. Now I know that PBT's are not as reliable, but I would like to add that I was given another PBT at booking and I blew a .078 BrAC. I hired a lawyer to fight the criminal case and DMV. The military has initated an automatic chapter by our CG's policy letters (Chapter 14-12C). My biggest concern is that since I am under an MEB process and the CG has to decide on a chapter or the MEB, that he will do so without allowing the case to be adjudicated in civil court. AR 635-200 doesn't mention too much about DUI in that particular section.
Contact your attorney of record immediately as Avvo is not a substitute to assist in a live pending quasi criminal case.
