Can I get out of my DUI? How much will it cost?
I was pulled over Sunday (Jan 29th) morning and blew a .09 on the breathalyzer.
.09 is above the legal limit. To determine whether this case has any defenses or motion issues you'll need to hire an...
Does my boyfriend have a case against his OWI charge?"
My boyfriend was driving home after a Wisconsin snow fall and hit some black ice while going under the speed limit (due to conditions) and his tail end slowly slid into ditch with no injury or damage to vehicle. Ambulance was 10 minutes behind and they called police to figure things out. They performed a breathalyzer test and be blew a .13 although he said he felt completely fine (aside from it being 4am) and had stopped drinking 3 hours before as well as just eating food. He has a GID (gastrointestional disease) and has to take medication for it as well as is working out and consuming lots of protein. Does he have a case to fight the OWI? Or what's the best scenario here?
Any case can be fought. However, .13 is above the legal limit, so there's obviously a basis for conviction. The best...
Does Wisconsin's implied consent law allow a person arrested for DUI to consult with an attorney before submitting to a test?
Can a person arrested for DUI in Wisconsin call an attorney before being asked to submit to any form of testing to gather information about whether its best to take the test or refuse? And if yes, do officers have to provide phone books to the person arrested for a DUI in Wisconsin?
No, WI does not recognize any such right. All the officer is required to do is read the Informing the Accused form verbatim.
Why wasn't I told my license would be suspended/revoked for longer than agreed upon after the plea agreement was finalized?
I was offered a plea agreement where my 3rd owi (1st was over 26 yrs ago, 2nd was over 11 yrs ago) was reduced to a second, due to there being no records available on the 1st. Part of the agreement was a 17 month suspension/revocation of my drivers license. The plea was entered and the judge signed off. About a week later I received a notice from the DOT saying my license was being suspended/revoked for 24 months plus 38 days. Essentially 8 months longer than agreed upon in court. My attorney said, opps! I forgot to tell you that would happen. WHAT??? Why offer me a deal in exchange for my guilty plea if he, the DA and the judge know that isn't what is actually going to happen? I feel deceived and do not understand how this can be legal. Any ideas, suggestions? Thank you.
You have the option of paying your attorney to schedule a hearing and move to withdraw your guilty plea if you were...

2nd DUI in Wisconsin. Does that mean I will survive jail time?
Jail is mandatory, and the vast majority of people do survive it.
Can someone explain a little more
I was reading the state vs. Carter on how an out of state Illinois absolute sobriety tickets will count as prior owi offenses. However, I was reading a blog about how this case and decision does not apply to all states or instances is this true? What are you opinions?
It applies to OWI charges in WI, that is the case only stands for the proposition that IL absolute sobriety convictions...
