I am planning on pleading guilty in my case because I do not think I have much of a defense and I just want to move on and put this behind me. I hope to have my record expunged after the required 5 years here in AR. However, I am a little worried about giving myself to the mercy of the court. If I plead guilty can they just give me the harshest sentencing, without me having any ability to object to negotiate? The road block was in Lawrence County AR. I stupidly, as I now realize, admitted I had drank earlier in the afternoon. It was 10:50 pm and I had my last drink at 7. I had no trouble with balance or coordination during the field sobriety test but I feel I was visibly nervous. The officer stated the handheld BAC read high and took me to the station where I blew a .108. This is my first DUI charge. I've been told by an area attorney it is not even worth attempting the hearing with the co. Jdg and I will need to appeal for a Jury trial. But with probable cause and evidence of BAC above the legal limit, I feel it is a gamble of poor odds to go to trial. What would my defense be?
