DUI diversion revocation evidentiary hearing
Graduate student- charged with first time DUI in 2014- no record prior. Entered into pre-trial diversion which I completed flawlessly, no failed U/A-Breathalyzer, no missed appts, my D/O concluded my case would be dismissed upon my last appt Dec 2017. In March 2016 I received a notice of revocation of my previously completed diversion. This was due to a police report nearly a year prior that named me in a group of over 18 individuals that were halted by police for being rowdy outside a bar. I was never on bar property. Infact this incident was well over 2000-ft from the bar and I had only showed up minutes before to pick up friends. After explaining to police they took my statement, license, and let me be the first to drive off with the friends I came to pick up (they ended up letting everyone go). My name was on police report, thus it flagged the prosecutor at end of diversion background check. After 18 months of prosecutor plea's my attorney has now set case for an evidentiary hearing. I am not guilty, and do not want placed back on div/charged for DUI. If judge rules against, can I appeal/ fire attorney and seek new council? Thanks.
I don't understand a couple of facts from your question. First of all, if I understand you correctly, this would...
When I am restricted to only operating vehicles with an interlock system, am I legally require to install one in my car?
I was charged with a DUI in January of 2017, was approved for diversion and had my license suspended for 30 days followed by 6 months restricted to only operating vehicles with an interlock system. Am I legally required to install one in my vehicle or can I simply choose to not drive for the 6 month period?
You are ABSOLUTELY required to have the interlock system installed, in your name, on a vehicle for the full restriction...
Diversion revocation hearing
I was cited for DUI in 2015, no prior record. I completed the diversion program (1 year stint) without incident. 79 days after I had completed said diversion I received a letter in the mail stating my diversion was being revoked due to a police report in which the officer states I was a witness to an event at a bar. Nearly 3 years after my DUI citation and over a year after my completed diversion I am attending a evidentary hearing to refute this report (innocent & was not at bar or drinking). I graduate with an MBA in December, if revoked and charged this will have extremely detrimental affects on my life, career, education etc. IF revoked am I sentenced for DUI on the spot, or will I have time to appeal evidentary hearing, plead non-guilty to orginal dui and set for trial, etc?
Review your diversion contract. I suspect it says that the prosecutor has 30, or 60, or possibly even 90 days to file a...

Can I get a DUI arrest dissmissed because police officer did not turn in any paper work??!
I was arrested for a DUI a year ago. I went to court 30days after my arrest and they told me that the officer never turn in any police report. They said they will send me summons to when to appear again. Well is being a year and still nothing. Can I hire a lawyer to have this dismiss pr have some type of agreement? Is there a statue of limitations on this?? I need to have this resolve because I want to become a US Citizen and they dont want me to have any pending cases. Thats what an immigration lawyer told me.
I am reclassifying this question to Criminal Defense so that attorneys knowledgeable min that arae could respond.
What will most likely happen when I go to court?
I'm on non-reporting probation for speeding, running a stop sign, no drivers license, failure to appear, and driving on a suspended. I paid off all my fines and the court clerk told me that meant my drivers license would no longer be suspended but I never followed up on it. Yesterday I got pulled over and charged with driving on a suspended (even though I was told it wasn't) and the cop technically arrested me but released me with a court date. What will most likely happen in court? Will I have mandatory jail time? I'm 7 months pregnant and I have a one year old so I'm very scared to go to jail! I don't have anything else on my record besides these incidents.
You admit that you "never followed up on it", i.e., getting your license revalidated from suspension with the DMV...
