I was arrested for a DUI and the charges were eventually dismissed. Will my insurance rate be raised?
I refused the breathalyzer when I was arrested and cannot get a license without an interlock system. My first DUI was in early 2010, 2nd in late 2011, and 3rd in April 2015. No accidents were involved, I have a perfectly clean record otherwise. I have a job and a house. I was the driver of our motorcycle, my wife was the passenger. She, as the passenger, by default, had to wear the backpack with our personal property. The backpack contained drug paraphernalia among other non relevant personal items. My wife admitted to the paramedic only that "we had used heroin" earlier that day then slipped into a coma. She suffered severe brain injuries and was never interrogated by the police. Upon arrival at the hospital I was asked by a uniformed officer if I had used drugs prior to the accident. I denied it. No charges have ever been brought but would like to get our backpack returned with our personal items [sans paraphernalia, of course!] Where do we stand? Penalty for contempt of court in the state of Arizona
A bench warrant was issued in my name for failure to comply with a court order last year. This stems from a DUI to which I pleaded guilty and was sentenced to 10 days in jail. However, due to being stationed overseas with the military I was unable to fulfill that requirement and the judge denied all of my requests to set the jail time to a later date. She has not cut me any slack for being stationed overseas. I will be returning to the states soon and would like to get this cleared up. What should I expect as far as the contempt of court charge? I will retain legal counsel but I would like to get some advice so I can know what to expect.
