Can I have this DWI dropped for lack of a speedy trial?
Was arrested in June of 2014 for dwi 0.8 . Went to court 2 times but my public defender could not reach a plea deal. Told by the judge that we would go to trial. I just got a letter with a court date ,from my public defender, In it he said he will meet me in court on the day of trial .it's been almost 2 years without a word from anyone .
It's possible. That is a very specific question dealing with the stated reasons for adjournments. Ask your current...

In theory it could be criminal mischief and if the damages exceed $250 it's the Class E felony.
Does a person on probabtion for a DWI felony have the right to marry an individual with no crimnal history in NY State?
My girlfriend and I consider getting married. However, she is on a five-year probation on a felony DWI conviction (sentenced in March 2012). She has a stable job and she reports peroiodically to a probation officer. She feels uneasy about raising the marriage question with her probation officer (a lady she does not feel comfortable with). She also does not want to introduce me to her probation officer. I have never commited or been convicted of any crime or misdeamenor, except for once driving without the seatbelt on - the "worst crime" on my record. I have a stable job in a professional position (research). We have been together for the past 3.5 years except for 3 months. We live in different but adjacent counties. Does she have the right to marry me? Does she need PO's approval?
Short answer - NO - it should not be an issue! Probation pertains to crimes, arrests, and acts that would cause a...
I was arrested on aggrevated dwi the other day. This is my first offense and never drink while driving. Will I go to jail?
Like I said I never drink and drive! My fiancé and I found out we were expecting a week earlier and lost the baby at work. I was so distraught over the loss and how to tell my fiancé I decided to drink. Stupid mistake! No accidents and no one was hurt. They stopped me for illegal lane change. But smelled alcohol on my breath. I messed up and I'm afraid ill be going to jail. I blew a .22!
It is difficult to predict at this time whether or not there will be jail. Contact at least one local defense attorney...

Can a pending DWI charge be transferred from NY to FL?
My daughter got a DWI in NY. She missed 3 out of 4 court appearances. Thus, the case is still pending. She was never told to attend any type of classes, given fines, or probation. She went to FL for a visit and decided to move there. She told us that she spoke to an atty who will simply "transfer" the case to FL so that she can deal with it there. Is this actually possible? That a pending case (where she hasn't been compliant) can simply be transferred to a new state?
I've never heard of this being the case.
