Do I still have to get a interlock device to get my license back after four years?
I had a DUI in 2012, it was my first offense and I got a diversion on it. I have never been able to afford an interlock system.
If that is what is called for in your diversion, then yes.
Can I operate a boat in Ks. with a Restricted (interlock/DUI) license
Currently am required to have an interlock for a Dui, can I operate my power boat on lakes or rivers.
As long as you have an interlock installed on it. I'm sure that you are restricted from operating a "motor vehicle"...
Can a Felony DUI be expunged? Can I ever own a Gun again?
I rec'd a felony DUI Jan 2009, priors were 14 and 19 years before then. I got caught up in the Kansas Life Time look back period. The laws are now a 10 year look back (Kansas), although the laws have changed back to a realistic point, they were not when this happened, I doubt anything is retroactive of sorts, but I'm defenseless in a dangerous world. I'm retired military and can't even defend myself or go bird hunting with my kid's and Grand kids, no other serious dings on my record, is there hope or even a loop hole on this past huge error on my part.. Thanks for looking at my question (s)
The laws concerning expungements are different in each state. Contact a lawyer in your area and make an appointment to...
Can a third (3) DUI be expunged in Kansas
Rec'd a Dui 1 Jan 2009, previous were 12 and 15 years prior, I got hung up in the life time look back era
Expungement is a right under state law. Check with an experienced criminal defense attorney in Kansas. Good luck to you.
Can I ever own a gun again after I recd a 3rd (felony during lifetime look back) in Kansas.
I recd a DUI 1 Jan 2009, prior were 12 and 15 years earlier, I got hung up in the Life Time Look back in Kansas, No other record to speak of,
Good question. This is certainly one for an experienced criminal defense attorney in Kansas to answer. Good luck to you.
Charged with DUI but was essentially sleepwalking from narcolepsy medicine. I did not consciously choose to drive. Help!!!
I have been disabled for 12 years for narcolepsy and depression and I don't drink alcohol ever. I Went to a friends house to spend The night and had two drinks in four hours. I then put my pajamas on and took my narcolepsy medicine to go to bed. I did not fall asleep right away like I should have so I essentially blacked out but was still awake (RX has same ingredients as date rape drug) and have no memory of anything that happened. My friend said that I got angry and wanted to go home and he tried to stop me but I was acting crazy and he couldn't stop me. I was pulled over and tested for a DUI and arrested and brought to jail. I have no memory of any of this so how can I be held responsible for driving when I was not even conscious. I did not choose to drink and drive.
You need to speak with a criminal defense attorney who can relay your medical condition to the prosecutor along with...
Should I request the officer be subpoenaed to my administrative hearing?
About two weeks ago I got pulled over for speeding, and the officer seen a bottle of alcohol in the back seat, I got arrested, while I was doing the sobriety test I refused the breathalyzer because he said if I did it would be an infraction like if I were to run a stop sign or speed, then once I got to the police station I did one and blew a .052, but I am only 20. I am sending in my request for an administrative hearing to the DMV and it says I must state whether or not I want the officer subpoenaed to go.
Absolutely no way of telling you this without first looking at all the evidence. This is what you hire an attorney for.
