What is the penalty for violating probation terms on 1st DWI conviction?
My boyfriend, who has/had only 6 wks left on his DWI probation in Montgomery County, Texas, blew two violations on his ignition interlock device (he drank at his birthday party the previous night and thought it would all be out of his system by morning...both violations are within minutes of each other as he attempted to start the car.) His PO told him she is sending him back in front of the judge next month. All other terms of his probation have been met (fines paid, no failed UA's, never missed an appointment with his PO, community service completed, etc.) What is the usual outcome in this sort of situation?
The entire range of punishment will be open to the judge. That could mean different things, depending on the facts of...

What is my husband looking at after his 4th DUI should I get him a lawyer? Or let him serve time?
My husband had his first DUI on 2009, second one on 2014 and the 3rd 2015. He was given 10 year probation and a month after he was detain on another DUI with a wrecked involve. He is now under a bond of $200,000 and is facing 8 years in jail. I want to know what his possibilities are as far as hiring a lawyer, I do not have money to be spending since I'm the only one providing and if anyone knows of a good lawyer in Houston I would greatly appreciate it.
You should ABSOLUTELY get him a lawyer. Letting him 'serve his time' could mean years and years in prison. A good DWI...
What happens if someone is on probation for dwi and gets into a very minor accident?
There was no police involved and no police report. There was only an only an insurance claim.
I wouldn't think that an accident would be a violation of probation unless you were not supposed to be driving. Read...
I had a DWI first offense misdemeanor conviction four years ago in Texas.
If the statute of limitations expires on a first offense dwi in texas, can you eventually have it expunged? I was much younger, and albeit naive at the time that all of this happened. So I guess my question is whether I can eventually sometime in my life have this charged removed, or if its just going to stick with me forever preventing me from getting a job again.
You are stuck with it on your record forever. Sorry to break it to you. However, a dwi conviction doesn't mean you...
