What is the penalty for violating probation terms on 1st DWI conviction?
My boyfriend, who has/had only 6 wks left on his DWI probation in Montgomery County, Texas, blew two violations on his ignition interlock device (he drank at his birthday party the previous night and thought it would all be out of his system by morning...both violations are within minutes of each other as he attempted to start the car.) His PO told him she is sending him back in front of the judge next month. All other terms of his probation have been met (fines paid, no failed UA's, never missed an appointment with his PO, community service completed, etc.) What is the usual outcome in this sort of situation?
The entire range of punishment will be open to the judge. That could mean different things, depending on the facts of...
Would I be charged with minor in consumption
officer did not administer breathalyzer, but I admitted to having one beer, also I was not operating a vehicle.
Chances are if the officer did not issue you a citation at that time you will not be charged. However if you do...
Will a Dwi follow me?
I am on probation in Texas, only reason im here is for school. I graduate in a couple of weeks and want to go home and i am transfering my probation. I got a dwi thats why im on probation. My question is, is if i do decide to stay and finish my probation here in Texas when i go back to Illinois will that DWI come with me like be on my record. Or will i be ok. i assume it will follow me because if it will i am just going to transfer it. Just want to know if illinois has a different law or anything.
The DWI will be on your criminal record for the rest of your life. Probation is a final conviction it doesn't matter to...
Is it legal for a police officer to report DWI to a university?
My boyfriend was recently dismissed from his medical school based on a tip from someone reporting his DWI. Upon reviewing the DWI video, the officer clearly tells my boyfriend that he is going to personally call his medical school and tell them about it because he was being uncooperative with a blood draw. His medical school sat on this information and then blindsided him 8 months later as a reason for dismissal. They even alluded to having knowledge about things that happened in the hospital based on what the officer told them. Are events that happened in the ER considered health protected information? Does this apply to police officers? My boyfriend has not been convicted of anything at this point. It's a shame for him to be 250 k in the hole when he has since dealt with his addiction
You may be asking the wrong people about your boyfriends case. It may fall under a civil action for defamation or a...
Applying for a job, and came across a DWI question?
"Have you ever been given a deferred adjudication or plead guilty or no contest for anything other than a traffic violation? (Mark yes if you have ever been given a deferred adjudication or plead guilty or no contest for a DWI offense:" I was not convicted as I did the PTI Program which later, thank God, got my case dismissed. I was going to answer yes, because it says deferred adjudication, but wanted to make sure. Am I correct? Thank you.
You are NOT correct. You have NOT been on deferred adjudication. Under Texas law, it is not legal to get deferred...
Can a failed breathalyzer test come up in court if I was not charged with a dui?
i got pulled over for making a u-turn when the light was yellow but turning red. I had alcohol in the car and am 18. The cop asked me to take a breathalyzer test just for his knowledge. I failed it but only got charged with a MIP. This is my first offense, should I just pay the ticket and do the community service to get it off my record? Will the failed test come up even though it is not on the ticket and I was let go?
Impossible to know without going to court and seeing what you're being charged with. You can either hire an attorney...
Can State of Texas report on my Texas driving record that I got a DUI in Texas even though I got it in NY state last year?
I plead guilty to a misdemeanor DUI in NY state in July (2015). I live in Texas and have a Texas DL. I have paid all fees and fines and have settled my case completely as far as NY state is concerned. Just got a letter today from Texas DMV stating I have to pay 3 years driver responsibility surcharges and am getting my DL suspended for three months.
Yes, it falls under the interstate driving compact. Texas is picking up your NY DUI.
