Should I let my prebond officer know about my interlock violation?
I got my 2nd DUI last month and got interlock installed. I recently blew hot and then 2 hours later i blew again and the car started with warn and I passed the rolling test. Should I let them know? I'm thinking about seeing an alcohol counselor as I have never seen one before. I don't want to go to jail and end up losing my job. Please advise.
You should follow all your conditions of probation and best to call your p.o. they will find out eventually and report...
I blew a 0.046, I know I look bad on video though. What are my chances of beating my DWI.
I reside in Texas and my arrest happened in Denton County. I fell asleep at the wheel due to a week of shitty sleep. I had a couple alcoholic beverages. I waited a bit until I knew I had the confidence to drive. Unfortunately, I fell asleep at the wheel because I was tired from a horrible week of sleep. Next thing, I woke up and I found that I am driving on the median and hit a light pole. My car was totally smashed but I was fine. I called the police myself (stupid) and told them I was in an accident. The officer did the field tests on me. I messed up a little bit on the walk the line test. He took me to the station and voluntarily had my blood drawn. I hired a lawyer and long story short, we found out the BAC level was 0.046. What are my chances of beating this thing along with bad video
If you have an attorney that person is in the best position to give you accurate advice. A low bac score does not...
3rd DWI, Is it possible to stay out of jail?
My brother was arrested during a "no refusal" last week for DWI, he refused breathalyzer and they took him in for blood draw. If his results come back that he was DWI this will be his 3rd offense. His 2nd offense was in 2007 (denton county) and first in 2003 (tarrant county). He has a steady job, a wife going to school, and just purchased a house. He admits he has a problem and has been seeing a doctor for depression even prior to the 3rd offense. What are his chances of staying out of jail?
Your brother need to retain a highly experienced DWI attorney to represent him. Without one, his chances of staying out...

I'm of pretrial release and forgot to my ua hotline on Saturday (yesterday) today is Sunday and I know there are not test done on Sundays so I did not miss a test. I have not failed a drug test since I have been on this pretrial release probation and I've been compliant with all my po duties, but I am still worried. What are the consequences for forgetting to call the drug testing hotline?
First thing tomorrow call in, tell them your mistake and find our what you can do for a makeup. Or speak to your...
Dwi trial resident.
My step dad was pulled over for Dwi last December. He is a legal permanent resident just renewed it about a year ago. My question is would he need to consult with an immigration and criminal lawyer. Or just a criminal dwi is fine? His case is pretty tough im some aspects, he is an older gentlemen has been a resident for more then 20 years never been in trouble with the law till now! he refused all test as well!
Your step father needs both an immigration and criminal defense attorney - as he is in serious legal jeopardy and these...
ALR appeal worth it?
I recently lost my ALR hearing and wondering if I should appeal. The reason is because I don't think the judge watched the dashcam video my lawyer used as evidence. I was pulled over for a headlight issue. My case involved me passing the single leg stand and walk and turn while exhibiting 0 clues. The officer though messed up on his report by saying I was swaying as a characteric (if anyone knows sobriety testing then you know swaying is a clue which creates a double negative on his report). I said I was not drinking and the passengers with me for the past 2 hours also said that I was only drinking water. I refused the nystagmus due to an eye condition even though the cop kept insisting that that test was the determinate factor for him in arresting someone. The judge ruled that because the officer said my eyes were red, smelled like alcohol, that that was probable cause for me to be arrested for intoxication. My lawyer also did not subpoena the officer to come to court since they felt it would harm the case but I actually felt differently. I am considering an appeal since the judge on his report also said I failed a test that I passed (# test) and am looking for a new lawyer.
No, it's not worth it. Your time and money will be better spent getting an occupational license so that you can...
Can texas charge a 3rd dwi felony when you only have 1 dwi in Texas?
My husband had 2 previous dwi'so in Arkansas and received 1 in Texas. All very low .08-.09 bac. Texas is charging him with a felony 3rd dwi. In Arkansas your 4th dwi is a felony. We are residents of Arkansas. They offered him 4 yrs in TDC, the same as a man with 6 dwi's all in Texas. How can texas charge him with a felony when only 1 was charged in Texas?
If the DWI occurred here in Texas, the charges com from the State of Texas, regardless of where he resides. Texas can...
