Is a second DWI in NJ the same charges as a 1st one if it is over 10 years later that you were arrested again?
getting a second DWI 12 years after a 1st one, how does that work in regard to the penalties? Confused
If the second is over ten years after the first one you should be able to get a 'step down' which means the second is...
DWI almost a year ago, still no court date. Lawyer hasn't even received the discovery. Does this sound right?
I got charged with a DWI last April, & was given a court date. I hired an attorney who postponed the court appearance and requested the discovery. Its almost a year later and still no discovery and still no court date. My lawyer says to stay quiet and we'll see how it goes. Does this sound normal to everyone? This is the 1st time I've ever gone thru with this, but friends of mine have had DWI cases & they went to court within a couple months of their incidents. I'm hoping the delay in my case going to benefit me rather than hurt me. What could be causing the delay in my case?
Something seems very odd. DUI cases in Nj are of the most serious cases In Municipal courts. It's not likely the court...
I was issued a citation, driving while DUI. Why should I hire any lawyer, when the law says what it says. And plus I told the
cop I was drunk, because the cop look like he wanted me to say it and I thought he was drunk too, with his ego. So, I didn't take the "test" breath, and the cop gave me consequential tickets, many, many tickets. So, do a lawyer here or anywhere have "connections" to give me good deal. I am guilty as a blue rock and I don't like fighting, plus I can get a ride to work and I am young and will be financially superb one day down the road, no pun intended. Driving while DWI is no fun, but paying the money? Ridiculous. Thank you.
Because a good lawyer can keep you from continuing with your non-defense. And get you a better result than you would...
Does an underage DUI from 12 years ago show up on a criminal background check?
I got a DUI and reckless driving when I was 19, which was 12 years ago. No jail time, just a fine. I am now preparing to go to nursing school. A background check is done, and it has to be clear. I obtained a massage license from two states and it didn't affect me. I volunteered the information, so I'm not sure what showed up on the check. It took forever to get those licenses, because the information I needed to send (showing all fines were paid) was archived by the municipal, and they couldn't find records. Nursing school is far more stringent. Does a criminal background check pick up prior DUIs? A friend who worked with a lawyer mentioned that from that time (2002) underage DUIs were no longer considered DUIs…thinking totally wrong, but that would be fantasic.
First of all, DUIs are not criminal offenses. You are worrying about something that you should not worry about. Unless...
Son arrested 4 DUI in NJ. Will his clean record & honor student status help?
Son is an honor student in grad school. Just began a graduate assistantship. Never even got a parking ticket. Dad passed 3.5 months before the DUI, after a long battle with Alzheimer's Disease. Cops said the extenuating circumstances would help son's case, plus the fact that he was very cooperative. Attorney says they won't help. Who's right?
I am not a NJ attorney but I was a DA in CA at one time. All factors are given consideration. Those you listed are nor...
1st Dui. Completed the 12 hour IDRC class, went to the assessment and now I'm being told I have to attend 16 week classes.
I do not have a drinking problem. I made a mistake. The person who did the assessement agreed that he did not think I had a drinking problem but said they refer everyone to the 16 week program. Is there anything I can do about this? I've been humiliated enough and I will never make this mistake again. Any advice would be appreciated.
I definitely need more information here. The IDRC does not routinely order 16 week programs on a first offense....
Can i get a new york dwai off my new jersey driving record as a dui
i was charged in new york state with a dwai blowing below a .08 and came off my record in new york and it now shows up on my new jersey drivers license as a dui
You can't get it off. A DWAI is considered in NJ a DWI and it will stay on your driving record for life. Thus the...
