I was charged with DUI 2nd and DUS 2nd. After review of my driving record, the solicitor has indicted me on Habitual Offender and is now asking me to plea to DUI 4th and DUS 4th...... Even though I was not in the car, hadnt been near the car for hours before my arrest. I would be willing to plea just to resolve the matter, but her recommendation is 1 year incarceration, 3 years probation with 6 months of it intensive. I have never been convicted of a DUI 2 or 3rd offense btw. I am a single mother of a child whos father died a couple years ago and I have no family as I was a foster child. I have a job and am President of my PTA.I am scared to death and dont know what to do. Any advice would be so greatly appreciated. I have a PD, but he has never and refuses to return my phone calls

I was recently arrested in South Carolina and charged with DUI2nd and a DUS2nd. I was not even driving the vehicle but rather had gone back to the vehicle hours later and the police happened to come then. That being said, the trooper charged me with DUI 2nd and a DUS 2nd. However, a few years ago I got a few DUI’s that are all resolved, fines paid, time served, but they were all resolved to DUI 1st and a DUAC…. Can the Solicitor go back and change my charge to reflect those or will I be facing the DUI 2nd charge? Has anyone ever seen them change charges to stack them against a person?? I recently pled guilty to a felony DUI and received 5 yrs probation with $30,000 in restitution along with agreeing to a civil judgment of $120,000. I did that because I have a decent job so paying $1,550/mth for 5 yrs, then $1000/mth the next 5 yrs is not impossible. However, my job requires me to travel pretty often and having no license makes that somewhat difficult. Does the judge not even have the power to make an exception for a provisional? Because I believe he would based on the situation to ensure the victim (who is fine now) received her judgment. This is my first criminal offense EVER! The cop that charged me didnt do a routine traffic stop he came to the rear of my home where I was parked but I was already out of the car when he arrested me. it was dark ( btw ) He obviously knew that my license were suspended.
