How much time will I have to spend in prison on revocation of probation on 3rd degree felony dwi.
I was put on probation over 3 years ago and this is my second revocation. I was reinstated cause I paid all my back fines probation fees and so on and then I couldn't stand my probation officer when I moved and basically said to heck with it. So they're revoking me again I was sentenced 5 years probated for 5 years and I also did 6 months in a correctional rehab and spent about 3 months in county. I have no new charge so I'm wondering are they gonna give me the full 5 years after I done paid all this money and did all this probation. Can they do that. I'm just like I should have just went then. Don't really seem to me like I'm a threat to people I don't even drink .
You were sentenced to 5 years, so it would be entirely logical to assume that your sentence would be imposed if you get...
Dwi for precription drugs in travis county
My husband was arrested for dwi while he was on prescription drugs xanax and hydrocodone 2 months ago. Blood was send to lab but the results arent out yet. I had 2 questions when does the result of a blood test come out typically in travis county and does the blood test show the amount of drugs or only the presence of class of drugs, are these test really conclusive about when was the drug last taken and how much. I want to know specifically for travis county as I know each county is diffirent. I would appreciate a response. Thank you
The DPS lab does the testing, and it can take 6+ months for the drug screen results. The lab results should show the...
I have a pending DUI and had two DUI priors dismissed so this will be my first DUI conviction.
I am being told the DA is holding my dismissals against me. How is a dismissal being held against me? Even with a criminal history, none of which are alcohol related and now I am being told they want me to do a lot of jail time. How is this right on a first conviction DUI
Pretty much they are thinking that you just got lucky and got away with the cases which were dismissed. It's a bunch...
If one gets a dwi can they still use their authority with other drivers?
The question doesn't make sense. What "authority" are you talking about?
DUI arraignment lawyer did not appear, what should I do? Or can do?
I had a DUI arraignment for Denton county due to my DUI. I hired a lawyer and the lawyer did not appear today. The Secretary said he did. The court docket said he did not. I already paid him 2,000$ that I had to divert from going to school last semester.. I don't want to lose that money. What actions can I take?
First, I hope that you kept your receipt for the money that you paid your attorney. Secondly, you probably need to set...
Will I be required to install an interlock device before going to my arraignment (first time DWI offender BAC >.15 )
I have my first arraignment date after 7 months of silence from the courts with a charge of a BAC > .15 which is really concerning. I know it's a class A misdemeanor and what that entails, but I just received a call from the Bail company stating I had to get an interlock device before going to the arraignment? The lady said if I don't the judge will throw me in jail on the spot (what a wonderful phonecall to receive while at work). any guidance would be appreciated and I'm in the process of finding a qualified attorney who specializes in chemical tests (my blood was pulled multiple hours after I was stopped, there is no way it was that high). All that I was waiting for was my arraignment papers. Thanks.
Your bondsman could very well be correct. Her warning was to help you, not cause you grief. She is trying to keep you...
Can my brother get a nearly ten year old Texas DWI conviction overturned?
This was his second conviction in about 2006, and he plead guilty to it without the benefit of any attorney. He was young and impressionable at the time, and he was told that if he signed the papers, they would release him from jail, so he did without a very clear understanding of what it meant. He did this even though (he claims) he was innocent. He says he wasn't even driving the vehicle on that occasion; he just wanted out of jail and that was what he thought he had to do. He didn't think much about it until recently when he was again arrested for DWI. He is now looking at a felony charge, whereas if he would have been acquitted of the second charge ten years ago, the current case would only be a misdemeanor. Is there any way to get a day in court on that older charge now?
Why did he not have an attorney? Everyone is entitled to an attorney for a criminal charge. If he was denied an...
