I seem to find new bills trying to be passed to make DWI checkpoints legal, but I cannot find the Statute number that prohibits a police department from conducting DWI checkpoints. Everything I have looked up just says that there is a statute but there is not a reference number to go along with this statement. is this statement true?
Not sure about a statute, but there are no OWI check roadblocks in the state. Having moved here from another state...
I was arrested for OWI (3) back in October 2011. After several pretrials and motion hearings the jury date was scheduled for this coming July 2014. This date was set several months ago but now the DA is saying the officer is unavailable for that date (the officer works in a different state now), so the DA is going to dismiss the case and then re-file the case. I know double jeopardy probably does not affect this case but is there a statue of limitations on this, is there anything I can do?
The statute of limitations for misdemeanors is three years. As long as the case is filed before October, 2014, the...
I am from WI and got a DUI in Washington State. Should I appear? I may be able to use the off road defense. Appearance 10/30
We were off the road parked with the intention of calling LYFT (cab) when cop pulled up behind us ( no good reason). Wisconsin is not a "reporting" state. Should I fly out? Can an attorney appear for me? From what I understand Washington State has an off road defense - if you pull off with the intention of not driving further when intoxicated that can negate a DUI. Please help.
You need to repost this question using the city in Washington where the case is venued as your location, as you need a...
Are the police allowed to delete part of the dash cam video of a traffic stop that lasted for over an hour including DUI testing
The deletion is for 10-15 minutes and includes me asking them repeatedly for a blood test instead of the preliminary breathe test. They refused to allow me the blood test and I finally did the blow test. They hid the deletion very well and only because I was almost sober that I remember the whole stop. Who should I contact . Department of Justice, District Attorney, or other option. Any help would be appreciated.
I am not a WI lawyer so I cannot comment on matters of WI law or procedure. However, had you asked this question in...
IL license and WI OWUI. Can I get a WI license before the hearing to avoid a longer suspension due to Illinois laws on DUIs?
I was arrested for an OWUI. This is my first offense, my record is completely clean otherwise. I currently have an Illinois license but have lived in Wisconsin for 5.5 years. In Illinois, A DUI means revoking my license. My schooling requires me to travel a lot all over Wisconsin, new site every 6 weeks and I am worried about the effects the Illinois license will have on that with a OWUI conviction here in WI. I plan to work and reside in WI when done with school but had not switched to a WI license yet.
I'm going to adjust your practice area to DUI/DWI so you will get some responses in your area. Good luck.
I recieved a DUI in wisconsin about 10 years ago. Paid my fines on time, and taken all required assesments and classes to get my license back. I've had a perfect record since then outside of a single speeding ticket. Is it possible to get the charges reduced, or expunged at all after the fact?
You are probably going to need an attorney file a motion at the very least. You should strongly consider speaking to an...
I received my second underage drinking ticket at a University of Wisconsin-Madison football game. What actions should I take?
My first drinking ticket was over the summer. I received this new ticket because my friend passed me a cup walking into the game and I took a sip. Officers then arrested us. After being extremely cooperative, I agreed to a breathalyzer. He noted in the report I was cooperative. I am worried about losing my licensee and having the ticket on my record. Should I plead not guilty? If so, should I seek legal council? After asking others who have received an underage at Madison, most say their ticket was dropped. What are the odds of my ticket being dropped? Any advice on how I should proceed will be greatly appreciated!
First, if you are concerned about the consequences of getting caught drinking illegally, stop breaking the law,...
