My DUI court orders from North Carolina were very specific about my requirements: alcohol assessment-pay fees-and 12 months
probation. However, my probation officer in Florida is requiring me to follow the general misdemeanor requirements of Florida such as not possession firearms-random drug test...My court orders did not require me to do so..What are my options? is that right for the officer to do so?
You were quite lucky to get the probation transfered to FL. We do things our own way here. You subjected yourself to...
How do I begin pressing criminal charges on a false drunk driving statement made against me?
The charges were made by my children's school on 2 separate occasions. The first date was Dec 16,2014 after leaving an IEP meeting in which my husband and advocate were both there with me and I had been sick with the flu that week. The 2nd date was Feb 10,2015 at school pick up when my children and I were walking across the street and their mother tried to hit us with her van by going the wrong way down the street towards us intentionally. The Asst. Principal witnessed the entire incident then later that evening the police were at my door saying the principal called and said I was driving the children while drunk. I told the police that as soon as I got home from the grocery store we started our homework. They said everything looked fine and the children were fine on both visits
If they reasonably believed you were driving drunk, it's not a crime. If they knowingly made a false report to the...
Moving to NC from Florida with a second DUI conviction within 5 years.
I received my second due in dec 2012 (first was March 2009) and I am currently under the 5 year revocation. I had planned on returning to my home state of NC after the 5 years had passed (March 13 2018 is when the dmv stated I could obtain my license) but I will need the interlock device for a year. Is it possible to have the interlock monitoring completed in NC? I really want to move home now but clearly. We'd to drive so waiting another year is just a dreadful thought. Thank you
You will have to comply with the interlock requirement to retain your driving privileges in Florida and NC. Most...
Florida DUI. Administrative and Criminal suspensions over. Moving out of state. FR-44, SR-22 Question
Have a simple Florida dui with Florida license. 6 months Administrative and Criminal suspensions over. Been without a license for over 8 months. Moving to California the next month. My license is still suspended in Florida because of the FR-44 conviction. Would it be necessary that I buy FR-44 in Florida to terminate the suspension and then apply in CA or I can just apply in CA and the CA DMV will require that I have FR-44 under the CA license? Will this put me in any trouble if I'm caught driving in FL with a CA license? (visiting parents). Or do I have to have 2 insurance policies. FR-44 in FL and SR-22 in CA? Thank You.
Highly unlikely that CA will issue you a license while your Florida Driving Privileges are suspended due to the...

There is any way to get hardship license or bussines license after second breathylizer refusal without waiting 18 months?
In 2005 I was charged with a DUI and refused to submit to a BAC test after running my car into a ditch. I took the guilty charge and suspension and went on to a career in the military. I am now a reservist and was arrested in DEC of 2014 for sleeping in my parked vehicle on the side of the road. I was in possesion of the keys so I was charged with my second DUI. Obviously because I was not driving I refused the BAC test at the time. (What I thought was a good idea at the time). I did not know however that my license would be suspended for 18 months with no chance of getting a hardship. Is there any hope of getting a hardship? I have already challenge the suspension and was denied. I need to get to drill every month and it will become problematic to get to training events in the future.
Unfortunately there's no hardship license issued on a 18 month hard suspension.
Is it illegal (obstruction of justice) to suggest to a person who has already been placed under arrest for DUI. Not to blow?
A DUI stop was conducted outside my condo. I used a cell phone to record the incident. Which agitated the police. After they placed the woman under arrest, I suggested she not blow. At which point I was told I am under arrest.
It is obstruction if the state can prove beyond a reasonable doubt that you interfered with the police officers lawful...
