Do I need to Tell my school district about DWI arrest and/or conviction.
I was arrested in Saint Louis Park MN for DWI and blew a .13. This is my first offense. I am a high school teacher and do not work in the Saint Louis Park distirict or in Hennepin county. Do I need to notify my school district of my arrest or if I am convicted, do I need to tell them? I have been a teacher for 8 years and had my background checked at that time and do not anticipate another background check form them.
Your teaching contract or CBA probably specifies that you are required to disclose any arrests, but check that document...
I'd like to know more about the one day DWI program in Hennepin Count.
I am a first time offender and had a BAC of .13, so I believe I will qualify for the one day DWI program. If I do this will this be in place of other fines, etc? What are the advantages and disadvantages? When do I ask to be a part of the program? Before I am convicted, do I ,mention it to the public defender before meeting with the Judge?
The One Day Program is a typical requirement in first time offenses, and usually the court will sentence you to do it...
I am 17 years old. Two days ago I got a DWI in MN. Am I guaranteed to lose my license til 18/other Vanessas law stuff ?
I am 17 years old and got a DWI In Hennepin county Minnesota on Monday night. I know that I need a lawyer-working on getting one now. I am really scared that I am jug totally gong to get screwed bc of Vanessa's Law. Will all of the possible things that could happen to me with that law guaranteed to happen or could a lawyer help get me out of some of it ?
Good DWI lawyers, like me, win a substantial proportion of their cases. I never know ahead of time which ones I will...
Can you be convicted of a DUI in MN if you are standing next to your car with keys in hand?
The person states that he had not entered the vehicle and had no intent to drive, but they are charging him with his 5th DUI. Also, he has refused to submit to testing twice - this time and the most recent DUI in 2007. He cannot afford an attorney and will be using the Public Defender. What are the possible outcomes?
It depends upon the case law of MN as to whether being next to the car with keys in hand can be enough for operation....
Out of state DUI and probation ?
I'm being charged with first time DWI, and my first court date isn't until the middle of July. I'm also a airline pilot. How will the courts handle probation and my ability to freely travel around the country? Surley the courts will understand they cannot restrict my travel and I cannot randomly show up to take a drug test if I'm away for work. Also I have a interlock and I unfortunately blew over the 0.02. This happened at 4pm... I thought after 14 hours after drinking I would sober up. Apparently not. I received a letter stating my interlock is being extended an additional 90 days. Since technically I'm not on probation yet, would this have any effect on my sentencing and what type of probation I'll receive?
Travel restrictions can generally be avoided in a first time DWI case, however, every case is unique. You should...
Is a DUS a probation violation from a DUI charge in a different state?
If someone received a DUI in MN with license revocation then received a DUS in another state is that a probation violation? What are the most realistic penalties on that?
Likely yes. A DUS can be a misdemeanor criminal charge and thus, reason to revoke probation. Get a lawyer right away....
I recently received my 2nd DWI in 6 month. I was sentenced to 60 days of house arrest, but I only had to do 32. Is this right?
I was convicted of my 2nd DWI in 6 months and my punishment was not only losing my vehicle, but also 6 days in jail, a ton of community service, and 60 days Electronic Home Monitoring. When I went to have my bracelet put on, they informed me my release date was July 5th. That was a little over half of what I was supposed to serve. They informed me that if I followed the rules, the EHM would end early, but if not, I would have to complete the full 60 days. Is this right? Will they later try to come back and make me finish the remaining 28 days?
You are likely getting credit for good time and possibly a jail credit you have already served. If you would like more...
