Can I do anything further to get my suspended license back after a refused breathalizer, and Attorney General disapproval?
Here was my original question on fighting the DLD to get a potential reduced sentence on my 18 month license suspension. http://www.avvo.com/legal-answers/should-i-fight-the-dld-to-get-a-reduced-sentence-o-2431302.html Well, I went ahead with it, and I just got paperwork uploaded by my lawyer which says it was denied by the Attorney General. I haven't gotten ahold of my lawyer yet, but is there anything else I can do? I have a great job, I'm a mother, I've never had a previous DUI. 18 months just seems excessive. I'm going to have to spend a crap load of money on Uber just so I don't lose my job, I already rented out my house and got an apartment closer to work... Do I have any other options?
Speak to your lawyer regarding this. If you already have an attorney, that's going to be much more helpful than...
What is protocol and how do get started?
In the interest of brevity I will get right to the point. This case is over seven years old and currently stands as a failure to appear out of Deschutes county Oregon. On July 24, 2008 I was on my way home from the Eugene Oregon area after completing a construction project. I pulled my car off into a wooded area several hundred yards from the nearest roadway and went to sleep. Sometime later I was awoken and arrested for D.U.I. A few hours later I was released on “OR” with a court date in 30 days. I came back to Utah fully intending to return and contest the charges. Just days before I was planning on returning my father passed away suddenly followed by my brother, and I was thrust into the role of caretaker for my elderly mother. It was my choice not to deal with the problem at that time and I own it. I would now like to resolve this case. I have no expectation of going to trial and beating the charges. my hope is to enter into a plea agreement for a lesser charge i.e. public intox.
As a Utah lawyer, I can only offer you this advice: A Utah lawyer would be able to use the online service to look up...
Should I fight the DLD to get a reduced sentence on my 18 month refusal to blow suspended license?
I got a DUI in Utah. During my DUI arrest, I tried to blow into the breathalyzer, but I didn't do it right, and the cops were teasing me, so they asked me if that meant I refused. And so I said yes. Fastforward - I just got my license suspended for 18 months in Utah. My lawyer says I can fight it further to try to reduce the sentence, but I'm going to have to pay him $2,000 plus more dollars to do this.. Since I've already paid him so much, and it didn't seem like there was really anything he could have done for the first hearing.. I'm wondering how likely it is that the sentence could possibly be reduced at all? Is it worth fighting?
Driver license suspensions can be appealed and ultimately fought out in a District Court, so the possibility exists...
If you are currently a bartender in Utah and you get a dui can you no longer serve alcohol?
"Get a DUI?" I am a bit unclear. Meaning convicted or just arrested for DUI? Do you have a bartending license? Does...
Why did I get charged with a DUI? On Feb 28th 2013. My roommate and I were heading to a wrecking yard. He was driving.
We hit the edge of a cement barrier. It flattened the right front tire. We stopped. We got out and he started walking to the wrecking yard to get a rim and tire. We had no spare. I stayed with the truck. I was standing about 20 feet away from the truck. About 5 minutes later a police officer pulled up. I was drinking heavily the night before and I was drinking that afternoon also. I explained to the officer what happened. I told him my roommate was driving. We had a flat and that my roommate was walking to the yard to get a tire. We were not pulled over. And I was not in the truck. He did not believe me. I told him to head to the wrecking yard and find my roommate. he arrested me for a DUI. Did not check to find roommate. Also the truck is his and the truck is in his name. court 6-2-15.
Sounds like you have a good case and should plead "not guilty." If a jury thinks you are telling the truth, you should...
I got an alcohol ticket and I'm looking forward to fighting it. I need help with how i should go by it.
I hardly blew anything, I was handed a mixed drink and was drinking some (couldn't taste alcohol) I was told it had alcohol in it and stopped drinking it. I was supposed to be the driver anyways so I was not even planning on drinking.
You should go about it by hiring an attorney to represent you. There is no quick fix how to fight your case in court...
What will happen? Will they help me or just take my license away immediately?
I just got an underage drinking ticket the other night. I'm 18. I was told I could do a Plea in Abeyance if they let me. I just got this new full time job and can't afford to get my license taken away. I know I made a mistake but would they be able to help me out alittle?
Call the assistant district attorney handling your case and explain your situation. He may be willing to help. If he...
