Can I be denied reentry to the US for a 9 year old DUI?
I'm a permanent resident since 1993. I had a simple DUI misdemeanor in 2006. I applied for citizenship and passed the civics test in 2007 but I was denied citizenship because of the DUI. I remained a PR. My PR card expired and I renewed it in 2014 without any problems. Now I wish to travel outside the US but it will be my first time since before my DUI in 2006. My DUI record was expunged in 2007 so my record should be clean again. However I'm very afraid to leave the country if there's a chance they won't let me back in because of the DUI. Can they do that? Is it possible?
Yes you can be denied because of a 9 year old DUI but it is not likely.
Violating probation while on a deferred sentence. Felony DUI probation, then got a drug charge while on probation.
A friend of mine got his second DUI and it was a felony, he got a deferred sentence and was placed on probation (DA) for 2 years. Less than a year into probation, he violated it and got arrested for possession. Both arrests were in different counties. He went to court for the drug charge and got another deferred sentence and got probation for 2 years. His probation is up in October for the DUI charge. Is there a way he won't get punished for violating the probation or does someone always get punished no matter what when they violate probation? If so, what type of punishments are likely? He refuses to get help for anything and says he doesn't have a problem. Shouldn't his license be suspended? What's the law in Oklahoma for that?
He is the one who needs to be asking these questions, not you. Violation of probation can subject someone to being...
AGG DUI and DPS hearing in Oklahoma
I received an aggravated DUI a year ago in Oklahoma. I understand that the criminal case is separate from the driving record case. I am off probation, courses & comm service complete, fines paid etc. I am still waiting for the hearing with the DPS. As I understand, if the officer is present during the hearing and the DPS rep can find no fault with the incident, I will have to have an interlock in my vehicle for 2 years. This will mean that I will be out of a job since I will have to drive a company vehicle. This also means that this incident will have followed me for approx 3 years (assuming the DPS hearing will happen soon). What chance do I have to win the hearing? What can I do to help my case? I have a lawyer. This is my first offense and I completed everything with criminal case early
You have an attorney. Only he or she can properly advise you.
We want to sue a DUI D driver for punitive damages, that smashed both our trucks and cost me to lose a job and 2 contracts
We have the police report, estimates from body and mechanical shops and witnesses to the wreck. Both our trucks are undrivable and my wife is 100% disabled and i cant do my work without a truck. We want to sue te driver as it makes the insurance company represent them and exceed the policy limits to cover our loss
Aside from the insurance recovery, you can ask the prosecutor for restitution.
First offense dui probation violation
I am on 6 months supervised probation with 2 random uas per month. I failed a ua and have a failure to submit(based on color code supposed to call in everyday didnt call for a few days color was called and didnt know)...i have one and a half months left on probation. I have no prior duis Am i seriously looking at jail time or just extension of probation? Is it common for them to sentence jail for violation of probation. I understand I messed up and in no way am i asking for leniency or making light of the situation and I understand I have to reap consequences for not following my probation but if i am sentenced to jail, i know i will lose my job..i cant lose my job..can i request community service or another alternative in place of jail.?
Yes, you could be looking at jail based on probation violations... How likely that is depends on a number of factors...
