How much jail time am I looking at and will I have to pay the $2,000 surcharge for three years? I just got bailed out and court was reset to next month. I have a court appointed attorney but debating on hiring an experienced DWI attorney. According to DA, I blacked out at a Whataburger drive through and woke up in jail. I wasn't driving. No field sobriety test. I have no recollection of getting booked and blowing a .277. The only memory I have is being at my house and waking up in jail. I'm on disability and am prescribed Ambien and several other meds. I drank 4 glasses of wine. I'm guessing the Ambien was the culprit causing this whole ordeal. I would have never done this otherwise. I completely blacked out. What are the odds of dismissal or winning the case?

I was arrested for dwi and took the field test (did not bad but still fail..). I was polite and calm to the officers. I admitted that I have been drinking a fews. He told me I was going 10 mph over speed limit, even though I was going like 7 mph over. While they taking me to the station, they pull over another guy and arrested for dwi also. So now the guy is in the same back seat as me. It took at least an hour to arrive to the station to take the breathalyzer and the result came out .075.

I got arrested and bond out, that same weekend. While I was in jail, I got asked for my migratory status. I told the ICE dept. that I was a Permanent Resindent after several investigation on their system, they did not deported me back to Venezuela. This morning I got my first court and the judge recommend me to find a lawyer for the next court day. The judge also clarified that my Residency could be in danger for this delicate case of DWI (Misdemeanor Class B). I do not know what is the next step to follow nor which kind of lawyer should I get. The officer pull me over for speeding and swerving (I was messing with my CD touch screen). I was calm and polite about it. I told the office I have 5-6 beer (yes how dumb was I!). He made me took the field test, then took me to the police station 30 minute after the arrested to take the Breathalyzer test, and probably fail it. I know the officer have all the strong evidence against me. And I'm afraid I can't take it to trial. Should I just plea guilty or have a chance to fight for it? I'm so worry about this and I just done college and hoping to find me my first career job. I know I make a huge mistake and have learn my lesson. Hope anyone can help me answer this.
