Underage drinking citation a month before turning 21, have already done court diversion once. anyway to keep my license?
i was in a car that was pulled over. the driver had drank earlier and is now facing a dui. i was in the car and refused the Breathalyzer. i was arrested because i had previously completed a court diversion program 2 years prior. is there anyway that i can keep my license. i need it to commute to work and class
Since you refused a breathalyzer, how do the police know you had been drinking? I suggest you pay for a consultation...
Does it make sense for me to hire a lawyer or should I just plea guilty?
I was arrested for a dui in Vermont, this is my first offense. From my understanding, Vermont does not have a work permitted or hardship license. Is it even worth it for me to fight for it. I'm not contesting that I was speeding or over the limit, I just want to be able to drive to work. Like I said this is my first dui and I don't know the process, I'm willing to pay any fines I have to but I don't want to receive jail time. I'm just feeling so overwhelmed.
In response to your question and with my personal inclination, I would highly reccommend that you hire a Criminal...
How long can I expect DUI classes to take? Can I transfer classes from Colorado?
While in Colorado I was convicted of DWAI. I have priors. Colorado has a lifetime lookback so priors from 12 and 15 years ago count for both sentencing and for DUI class length. If I can move back to Vermont how long can I expect DUI classes to be? My BAC was 0.09. Also will I be able to transfer the 6 months of classes I already took in Colorado?
You only need to post a question once!!!
Will someone with his 6th DUI, out on probation for DUI#5, get prison time in Vermont?
My ex just got DUI #6 in Vermont. He just got DUI #5 in VT on June 26, 2015, so about 6 months ago. This is his 3rd DUI in VT. He has one in PA and two in FLorida. In Florida, his license was permanently revoked for DUI#4. He is currently on probation from DUI#5 and has violated 3 times by drinking, driving w/ no license, harassing others, violating curfew, missing visit to probation, etc. He was put on Strict community supervision Nov. 1, 2015 and given curfew, no alcohol, treatment, etc. He also is a convicted felon in FL with domestic violence/aggravated assault w/ a firearm and battery on a person over 65 charges which he did prison time for. He has a history of violating probation and/or house arrest more than a dozen times in FL on top of his VT violations. He also has 2 other domestic violence convictions in FL. Given his extensive criminal history, his inability to stay sober or follow conditions of release, do you feel he will be charged as a habitual offender and be given real prison time? He is currently in VT prison waiting until the end of Feb. for his VOPhearing. He has a $50,000 bond. His probation officer plans to use EVERYTHING against him.
Possibly. Your ex needs to speak with his public defender.
Visiting VT from CA with a Non-Updated DUI License
I am visiting some family in Vermont. The story is I got a DUI a year ago. Completed all court and DMV requirements to be reinstated. When it came time to remove the interlock, I went to the DMV to update my license. Well they botched it and sent me the restricted license. The CA DMV appointments are so backed up, I am months away from changing this, but was informed by the DMV that it is not a problem because my updated status is in the National Registry. In fact I've been pulled over once in CA during this period and the officer confirmed I am okay to drive. Now my question is, can I drive in Vermont? Do officers have access to the national registry?
I am not licensed to practice in Vermont, so out of respect for any local experienced attorney from Vermont, refer to...
Caught underage drinking but no citation given -- what next?
So I was at a high school graduation party and was caught drinking by the police. I gave them my name and date of birth and took a breathalyzer test (blew a 0.079). The officers said that I could go through the court diversion process and they would give me paperwork before I left. They stayed with me until my ride came, but they never gave me any paperwork or said what they were going to do with me. Now I'm wondering what to do next; should I do nothing and wait or is there a way to find out if I have a citation/am in trouble? Thanks
If the officer purposely did not give you paperwork, it might be because he forgot but is still filing it with the...
Can a person get their license reinstated in Vermont if they have a permanently revoked lic. in FL for 4 duis?
I know someone who has a permanently revoked license in Florida due to 4 DUI's. 2 out of state, and 2 in Florida. The last DUI was in May 2011 and he received his revocation in July 2011. This person has since moved to Vermont. He seems to think he can waltz down here to Florida and get an administrative hearing and get his license back just like that and be able to drive freely in Vermont. How realistic is this? I fear this person driving because he is a very active alcoholic. Will it be easy to get his license back after 4 DUI's? The last one he had a UBAL of .23. If he were to get a hardship/employment license reinstated. , would he be able to drive in Vermont? Florida law says he cannot even get an administrative hearing until 5 years after the last dui conviction.
Permanent revocation means just what it sounds like. That suspension should make him unable to obtain a license in any...
