Was not drink am however on high does of prescription drugs. Township was Upper Gywed.
You don't reveal whether testing was blood or not. Breath testing would not reveal prescription medication which can...
Will a previous offense such as underage drinking affect my chances of getting ARD for a DUI charge?
About 8 or so years ago I got an underage drinking charge, my BAC was .03 i belive? Anyway I paid my fine and lost my license and its been in the past until now. I recieved a DUI and waived my rights and applyed for ARD. I have my CRN next week followed by my arraignment in Bucks County. What should I expect, will I know if i am accepted into ARD? Will this previous charge of underage drinking hurt my chances of getting ARD?
The old summary offense should not prevent you from getting ARD. The BAC may be relevant along with your license status...
My husband has just had a 2nd dui. He was in a single-car accident (he hit a wall). His BAC will be very high. He is 61 years
old and is a Type 1 DIabetic; he became very overwhelmed and was having high anxiety and made an attempt to cut his wrist. I took him to the er where they stitched him up and put him into crisis care management. He volunteered to be hospitalized at a dual-diagnosis clinic for a 72 hour observation period. According to the tier, he is facing 90 days incarceration this feeds the anxiety (and depression) further. I support DUI laws, but am fearful that he will either try to harm himself again or just leave. He is a very good man; his health and job loss along with his Type I diagnosis (a few years ago, leaves him fragile. I don't think my county supports house arrest - is there any path to pursue to avoid so much jail time? Thank you!
Unfortunately, if he is convicted then the judge must impose a mandatory minimum 90 day sentence. House arrest is very...
Was i cited for DUI?
I was stupid and got pulled over for DUI. I was taken to the station and had to give a blood test. Thing is now, I'm not sure what is going on. The officer was nice enough to take me home after the fact but I didn't receive a ticket or any paperwork what so ever. What is going to happen now?
In about a week you will get a criminal complaint in the mail. It will also include the date of your arraignment and...
I need to know if they can issue a DUI to someone who was parked in a parking lot
My nephew got a DUI. He was not driving when they found him he was parked in a parking lot. The story gets complicated because he was with my 8 year old son at the time. I was the one who called the police because he was so drunk he could not communicate and I could not find him. So he was charged with child endangerment as well.
The short answer is maybe. In order to provide legal advice, I would need to know more about the specific facts. I...
How can I get my driving privileges back as quickly as humanly possible?
I am 20 years old and my license was suspended for an "underage" (four crushed empty beer cans in a trash bag found by two nosy park rangers.) I am a resident of Pa and have had one prior underage, this bars me from receiving a probationary or limited license. There is no way to drive for over a year and I was wondering if there are any other appeal processes or driving classes that I could take to reduce the sentence or if there is a fee that I can directly pay to instantly reinstate the license? Thank you very much for your reply
If you were convicted in both cases, the answer is no. Penndot is dificult to work with on their best days.
Suspended License in Different State?
Hi everyone, and thank you for your time. I recently got a DWI in New Jersey. My diving privileges in NJ are suspended for three months. This was a month ago. My home state (part of the interstate compact) has still yet to suspend my license. As long as my license in my home state is valid and I am not driving in NJ - am I OK to drive? Best,
Yes. As long as you are not driving in New Jersey.
