What is the point of having a lawyer for a dui?
we have a dui in excess in the state of Idaho. I understand what the minimum and maximum sentencing possibilities are. so what is the point in paying for a lawyer? what will they do for me?
Attorneys can be pretty amazing. Even though you think the result in your case is preordained, consider the...
Possible motion to suppress DUI charge?
Long story short: the preliminary cause (traffic violation, speeding) is NOT listed on the first ticket filed (which sites the DUI and other misdemeanor charges), according to Idaho repository and the county clerk, the preliminary infraction was filed TWO days after the misdemeanor charges (there is also no recording of clocked speed on ticket). Would this be a valid motion to suppress or dismal of charges?
Nope....................................................................................................................

How do I apply for a job if I haven't been to court. I was arrested for a DUI and a conceal and carry while intoxicated.
I was pulled over for not having a front license plate displayed as I was leaving a bar. I told him I had a concealed weapon he kindly told me to but my hands on the steering wheel which I did and did everything the officer asked of me perfectly. I take adderall for my ADD so when drinking I didn't notice I had that much to drink. I thought I was fine. I blew in the alcohol testing device and it said 1.8 which was surprisingly high since I didn't feel or talk (slurring my words etc.) drunk. I could think perfectly. I'm trying to apply for jobs but I don't know if I am able to say yes I have been convicted of a misdemeanor (which they both were my first; I was unaware that concealed while drunk was a bad thing since bars are dangerous every time I go. So I brought it for my own safety. I just was wondering what I should put on my application. My court date isn't till the end of next month. So is it on my record now or do I wait till after my trial to start applying for jobs? Thanks for your help.
If the case is ongoing you likely have not been convicted of a misdemeanor yet. If this is the case, at this point you...
Can I be arrested if I have a drug test come back as positive for weed?
I felt bad for a guy because he was in the same situation I was in about 2 years ago so I gave him rides talked to him and smoked weed with him one time. He got kicked out of his apartment because his roommate found some serious drugs in his room he asked me to pick his stuff up. (Only knew him for about a week) when I came to pick up his stuff his roommates wife was yelling at me and filming me and my licence plate. I ended up yelling at the guy for putting me in that situation because I don't want anything to do with any drugs he started threatening me. I blocked his number what I'm afraid of is cops coming to my house with CPS because I talked to the guy and smokes weed with him once.
How is what you described related to dui? I doubt that anything will come of what you have described. But if you are...
Do I need to say yes to conviction of a dui on a job application if I received withheld judgment?
I got withheld judgment for a dui back in 2013. I completed all my terms and fines and probation and I recently went to check the Idaho repository and I can't find any record of my dui case on there. Do I need to answer yes to being convicted of a dui, when asked on a job application, even though I got withheld judgment and it's no longer showing on the repository?
You answer "no" to any question that asks about a conviction for a crime unless there has been a conviction. A...
Probability of DUI dismissal?
Long story short, profiling in small town, refused FST and breathalyzer, but requested blood test and the arresting officer did not take subject for blood draw/testing. How likely is dismissal?
No one can tell you the likelihood of dismissal. The fact finder (judge or jury) will be forced to rely on the...
