Am I going to jail Friday?
I got a DUI back in August and have followed all rules given to me since then. Completed ASAP classes, paid all fines, and had an interlock device in for 8 months now. I was originally supposed to have my interlock device installed for six months, but I failed for mouth wash. When I spoke to my case manager she told me I have the option of keeping my device for an extra 6 months, or seeing a judge and asking him to waive it. I opted to see the judge, but when I received my summons it says I need to appear and show cause as to why I should not serve my previously suspended 30 days of jail time. Will I likely be going to jail, and what can I do to try to avoid it?

I'm 16 and I went to a party where there were about 40 people there. I had 1 or 2 beers and told the officer straight away when he asked if anyone had anything to drink that I had. I blew a .046 which the officer told me was half the legal limit. He had me call my parents and thanked me for being honest with him. He told my parents and I that I will probably not get my license suspended and it will not go on my record but it depends on the judge. I have never had issues with the police before and this is the first time I've ever done anything. Should I plead guilty and express my guilt to the judge and hope he places me on probation or what should I do?

My wife's a drunk. She hasnt had a DUI yet, but drinks and drives all the time. I used to take her keys away and lock them in the safe on a regular basis while we were together. During the 6 years we were together I think she was hospitalized for falling down the stairs twice and for alcohol detox with DTs 3 times (Or something like that, I lost count). Now that we're getting separated and I've found a place to stay, I kept her keys because I feel that I would still be liable if I let her drive. Is that correct? Can I address this in a separation agreement or do we need to re-title the cars and re-do the loan first? What if she gets a rental car on her own credit card?

If a cop doesn't give you a DUI at the scene or inform you of your BAC or results of your other tests, what should I do?
I was given a reckless driving and possession of alcohol ticket. I am 19 and my parents don't know that I was drinking while driving. I have been told my BAC will be brought up in court, but I wasn't given it. I was given other tests and wasn't told if I passed. I understand they tried to give me another chance by not charging me with a DUI, but can they still when I get to court. I have never had any prior charges with the law of any sort and have good grades and no accidents prior to this. I understand I deserve a punishment but would like to understand to what extent this could be. While the punishment does vary judge to judge, I was wondering if this will get taken off my record somehow since it is NOT a felony because they didn't charge me with a DUI.

Drunk & doped up driver hit me. Totaled my car, tore my leg and foot up, shoulder and have 2 compressed vertebras in back. Should I represent myself in court for a probation violation?
I received a probation violation for a DUI in 2012. The violation was for noncompliance with VASAP. After I was convicted for the DUI I was told to visit the ASAP rep before I left, which I did, and get the paperwork for the drug program. While speaking with the lady I informed her that I was not a resident of Virginia and would be leaving the next day to return back to New Mexico. She asked me for my license because part of the judgment was for me to surrender my driver's license, to get a restricted license for a year and get an ignition lock on any vehicle registered to me or that I operated. I gave her my license and told her that I do not own a vehicle. She then told me that because my license was not a VA license that she couldn't take it and then allowed me to leave. Upon my return to New Mexico, my command (I was in the Air Force at the time) mandated that I completed the Air Force drug and alcohol assessment which deemed that I was not at risk for alcoholism. I have not been able to secure a lawyer, and it is now too late for me to get a Court-appointed attorney. I have also tried to go through Legal Aid but they do not help with criminal cases.
