It has been 14 years since I got in trouble. I would like to get my Minnesota driver's liscence . a few yes ago I tried but couldn't gwet it. Howmlong does it stay on the database?
If there's a hold on your license in Colorado? --- Forever or until you get that hold cleared.
I am awaiting the results for a DUI blood test taken in Colorado. Will the charge show up on a Connecticut background check?
In Colorado, a cop approached me after I had parked under suspicion that I was driving under the influence. Upon completing a field sobriety test, I opted to take a blood test at the hospital. I was then dropped off at my hotel. No fingerprints were taken, and I was not brought to the police station. I currently live in CT and was just offered a job. The blood test results have not come back yet, but I am worried that the charge will show up on a criminal background check.
Currently, nothing should show because the backgrounds do not hit NCIC or NLET without fingerprints and photographs....
I was recently arrested for a DUI and submitted to a breath test on the Intoxilyzer 9000.
I failed the breath test and my license was revoked after my CO DMV hearing. The caveat is that my lawyer and I found out that the breathalzyer machine's certification was signed with a stamp from a guy who hadn't been with the company in years. The judge in the county is going to rule in several weeks regarding hundreds of DUI cases and whether the breathalyzer results should be thrown out. My question is...if the machine wasn't legally certified and the signature on the certification was fraudulent, is there any way to appeal the DMV hearing decision?
If you have an attorney already, you really need to ask him/her. There are several highly-skilled attorneys fighting...
Will I have to go to jail for Driving Under Restraint in Colorado and if so, for how long?
I was charged with Driving Under Restraint while vacationing in Colorado. The officer told me that the reason for my license suspension was because of a DUI. I am originally from Arizona, but I got the driving under restraint charge in Colorado. Will I have to go to jail for 30 days in Colorado? Is there a way to plead to a lesser charge that does not include jail time? Arizona does not give mandatory jail time for a first offense for driving with a suspended license, but Colorado statute says its a mandatory 30 days in jail. Is this true? Can CO sentence me to jail time when I live in AZ?
In Colorado you are facing a minimum mandatory 30 days on the original DUR charge. It is based on the fact that the...
What happens if I was charged with "Driving Under Restraint" while on vacation in CO, but live in AZ?
I am from Arizona, but I was on vacation in Colorado. I got pulled over, and the officer cited me for "driving under restraint" and "violation of restrictions on interlock device" (statute 42-2-132.5(10)(a). I am now back in Arizona, but the officer said I have to appear in court in Colorado in a few months. Do I have to go back to Colorado for court and will I be charged there? What kind of charges am I looking at? Will this affect my AZ driver's license? Under the Interstate Driver's License Compact, it says that I will be charged as if this happened in my home state (AZ), is that true?
You need to retain counsel in Colorado, and without reviewing your case it's hard to say what will happen with your...
What happens if I was charged with "Driving Under Restraint" while on vacation in CO, but live in AZ?
I am from Arizona, but I was on vacation in Colorado. I got pulled over, and the officer cited me for "driving under restraint" with the specific charge being "violated restrictions on interlock device" (statute 42-2-132.5(10)(a). I am now back in Arizona, but the officer said I have to appear in court in Colorado in a few months. Do I have to go back to Colorado? What kind of charges am I looking at (what kind of charges does CO usually give for this type of violation)? Will this affect my AZ driver's license?
If your Arizona license is the one under restraint, you'll need to ask an Arizona lawyer about these impacts. Arizona...
How should I approach my situation?
11/2 years ago I witnessed a roll over accident. It was in a blizzard and freezing temps. I saw car go off and roll. I pulled over and finally got them out of the hatch back. They were both very under the influence. The wife came out first and immediately stated that she was not driving. I said that in witness report, she continued to say that to the EMT's and Sheriff. Now I have to go to court to be a witness, and there saying she was driving? How do I approach this?
No need to worry. You don't have an interest in the case. Just answer the questions as best you can and tell the truth....
