My family almost died on 02/04/12 in a car accident with a driver that appeared to be drunk, with a party band on his wrist and stinking of alcohol. The trooper indicated this in his assessment at the scene of the accident. Lester Ray Smith, the drunk perpetrator was ultimately flown to Orlando Regional Medical Center .. He was driving on a suspended drivers license and the vehicle actually belonged to his brother, who should also be responsible since he must have known his brother had his license suspended, especially since he just got out of jail for the same crime. His Insurance paid $20,000 max which does not cover the bare minimum costs. What can I do, he has no assets?

Hi. I had my first DUI in February of this year. I have completed all of the conditions (car impound, counseling, DUI school, etc). My remaining fine of over 2,000 will be paid this month. Problem is I did slip, and I drank, and I came in, passed the breath alyzer but they surprised me with an ETG test. The original sentence was up to a year in jail, and if I violate, is there a possibility I won't "have" to do this entire sentence? I know I need treatment, I have been wanting treatment further after the few classes they gave me. I want to beg my probation officer/judge to help with that....and does my PO have to violate me or is it at her discretion? I mean, I hope it's negative, can't really afford the lawyer with my savings spent, but I know they help. Thank you.
Depending on your criminal history they can impose jail time or do nothing, or anything in between. I do not know...
2nd DUI in 4 1/2 yrs. None of what I was told is happening. Did not blow and no blood or urine test. So nothing but cops word. Lawyer said I past sobriety test. So need to know if I can appeal plea of no contest on this charge? Lawyer told me it was in my best interest to plea out. I felt forced into the plea deal.
My son was involved and injured in a car accident.The hospital drew his blood but left one of the vials at his beside and he disposed of it.They never missed it or drew more. Could this help him in a DUI charge?
