7/8/15 DUI/MD-FRA Suspension/M1-Drug Abuse/M3. He rolled his truck 4 times and lived with only minor abrasions. He was found with a few klonopins and a few muscle relaxers and 2 grams of marjiuana. He had some drinks not sure of b/a content. He had a temp permit. He is extremely depressed. After the accident he was saying how he should have died because everyone would be happier. He is homeless and has lost all possessions except for a bag and clothes. He can't hold a job because of his depression.I found a text between him and his brother from 6/14/15 saying "Im hoping this is my last week, and I can just go ahead and flip my truck already/Im at the end of my rope/Im sick of fighting" He says he was not marandized. How strong is a blood test in court for an ovi
First, the blood sample may have fermented in the days before it is finally analyzed in the crime laboratory; fermentation will produce alcohol in the sample. Second, the blood may have coagulated; this decreases the liquid portion of the sample and thereby increases the percentage of alcohol. Third, if the sample was analyzed by a hospital, they will probably use plasma or serum rather than whole blood – which will give a falsely higher blood-alcohol concentration. Fourth, it is not uncommon for the chain of custody to be wrong: the sample analyzed may not have been yours
Well, it sounds like you've researched the entire issue and have learned all of the reasons a blood test may be...

No field sobriety test were asked of me or performed, i was taken to jail and asked to take a breathalzer which i refused and was then 3 hours later took to a hospital for blood sample which i was never shown the warrant.
