5 years ago I was charged with DUI in WV. The charges were reduced to reckless driving. I got a letter from the WV DMV saying I had to take classes. When I called they said since I was a PA resident that I would have to call PA DMV to see what they wanted me to do. When I called PA they said they had no record of it so as far as they were concerned I didnt have to take any classes. I just moved to Ohio and tried to get a new licence but was flagged by WV. Will I have to take the classes and if so will I be able to take them somewhere in Ohio?
Every State has conditions on obtaining a license. Driving is considered a "privilege," not a "right" and as a result,...
So I recently recieved a ticket for underage consumption. The ticket is for a whopping $550. When I was breathalyzed I blew a .5 and on the ticket he put .5. Obviously this is impossible. If I blew a .5 I wouldn't have to worry about the fine because I would be dead. I was given a court date this thursday. Could I get this dismissed simply on the fact that the breathalyzer was obviously malfunctioning? Any other advice?
First, a BAC of .5 isn't impossible. I've seen them over .7. Second, if cross-examined, the officer will almost...
I was convicted of my first DUI two years ago in which I blew the minimum limit .097. I attended the 6 week drug and alcohol class a year ago. I did not have the interlock system installed in my car. Is this the reason for which I am being summoned? Because I was under the impression that I did not have to have the interlock given the circumstances of the situation.
Minimum limit in all 50 states is .08
I got charged with first offense DUI September 2011. The judge did not accept a plea upon me voluntarily entering the interlock program. In March of 2012, i was caught driving with expired registration and charged with my second DUI because of my revoked status. DMV sent me no notification of my license being suspended or my registration needed renewed. The court of the Second DUI now has jurisdiction over everything, but they have yet to set a date for me to appear. After march, can i request for the case to be dismissed, take my classes, pay my fines and get the charges dropped and my license back?
While I don't practice in WV, I find it difficult to comprehend how you could be charged with a second DUI due to your "...
Was arrested for DUI in May of 2010. The criminal case was dismissed for lack of evidence and the officer never showed. My first dmv hearing was in dec. of 2010. In which the officer didn't show. The second scheduled hearing was scheduled in the spring of 2011 and continued to another date. Finally had the second hearing a year later in the spring of 2012. That summer I got a DUI in Ohio. Once they turned it into the DMV in January of 2013, then they issued a year long suspension starting in march. The DMV is saying this is my second even though there was no decision on the first. With no sign of a third hearing in sight to fight the first alleged DUI arrest. Help.
The only advice I can give you is to hire an attorney. Good luck.
