No, a DUI cannot be vacated, sealed, or expunged.
1st DUI. Reduced?
I got pulled over for my first and last dui. I declined the field sobriety test, was taken back to the station and blew .1008 and .1000. This is my first ticket of any kind. I was pulled over in king county. What are the chances of this getting reduced?
The breath test is merely one out of four factors the prosecutor will need to prove in order to convict you or anyone...
What are the consequences of a failed test and lockout on my interlock in the midst of a deferred prosecution on my second DUI?
I have two DUIs, but the second one is in a deferred prosecution. I'm right at the end of the first two years, a month away from completing treatment, and likewise parting ways with my PO. I just blew too high (barely) in my ignition interlock, and apparently its happened too many times, so I got an immediate "lockout". Every failure previously I followed with a clean blow, equating to a "false positive", not being reported to my PO or court. This time a second blow wasn't an option. I have my next interlock service in exactly one month, and by then I will be done with active probation with an officer, and I will have finished treatment (my last required class is in one week). Should I be worried? Can/will I lose my deferral for this? I have an otherwise spotless record...
You could lose your deferred over this. I know some Judges who take these positives very seriously. It can take...
I got a dui and blew a .16
I had 3 priors but the last one was over 17 years ago, am I looking at jail time?
I am not licensed in Washington, but it is certainly possible. You should consult with a DUI attorney in your area to...
Concerned about DUI resulting in deportation
I am a permanent resident alien in the state of WA. I have been in the USA for 29 years. Recently I received a DUI. There is nothing else in my background, no tickets of anything. I actually have a degree in criminal justice. I was considering pleading guilty to receive the less harsh consequences of "No Test" as compared to "Refusal". However, I requested continuance once I read the clause that if I am not a citizen, pleading guilty to a crime can result in deportation. Do you have any words of advice on this? I have been using a public defender and am concerned about this. My public defender told me not to worry about it, however verbal reassurances don't mean much when I am supposed to be signing an acknowledgement of possible deportation. Thanks for any help.
A conviction of simple DUI is generally not a basis for deportation from the US. However, if "There is nothing else...
I got a dui in wa. I blew .16. I have had 3 priors in Ca but they were 17 years ago. Will the 3 previous show up?
What can I expect igf convicted?
The only real answer here is that they probably will. While they will not show up on your Washington criminal history,...
How do I deal with the DOL if I have r been charged with a DUI?
I put in an "intent to defer prosecution" order with the DOL. They agreed to the order and to contact them 150 days from charge date or 2 years from the date of arrest. I have not even been charged for my DUI yet. The DOL sent me a new notice to now remove my driving privelages for 2 years because they haven't heard. How do I prove to them I haven't even been charged yet? My incident occurred on 28 Aug 2016. Please tell me they can't take my license as my intent is to still defer. I shouldn't have to request a hearing as I've already submitted intent to defer prosecution. Thanks
You were suppose to contact them within 2 years from the date of arrest, you did and now your license is suspended.
