Once a person is convicted and sentenced for a dui ,can they be resentenced because of a court mistake?
3rd offense dui child in car in sheboygan county wisconsin.was sentenced to nine months jail and 2 years probation case was closed.just started serving time.now court is saying a mistake was made with the probation part of sentence(apparently they cannot give probation for these offenses),and so the they made a new court date now ,which i believe is another sentencing hearing,but not entirely sure.public defender says she cannot guarantee they would not give prison this time.this seems very odd to me.is this even legal?thanks

I went up North to visit a friend. The bar was mainly glass so we could see the cars outside (and traffic). Everyone noticed the police kept stopping at my car (got rims on the car). When we left I was pulled over and given the sobriety test. Though their was no problems during the test I was still arrested. When in jail they asked me to blow in the meter again. When I asked, why? They claim I was refusing. They then took me to the hospital strapped me in a chair and drew blood. I later found out I was suppose to get papers stating my alcohol level when leaving the jail(learned this in drunk driving class). I got none. My friend later told me that everybody in town got DUIs. What the ....?

My boyfriend was back on a bench warrant for drunk driving for 2009. He has been in there for 8 days now, yesterday they cleared him that through the jail he is eligible to get out on a program. The only thing holding him back is an immigration hold. I have heard that immigration only has 48 hours to take him and interview him, but i called the jail and they said immigration can hold them for as long as they want? I called immigration and they said that they do not do anything untill his sentence is up, and his court dates are very far apart..so will he have to sit in there untill his court dates are up? I was sentenced for 2nd offense OWI. The prior offense was when I was a minor 7 years earlier. As part of the sentencing, I received the minimum 12 months IID restriction. When I reinstated my REGULAR license (after one year revocation and 4-5 months concurrent OCCUPATIONAL with IID) I noticed that the back of my license only has an IID restriction until mid June. The IID restriction should be in effect until part of the way through October (it was installed in October 2013). Error on the part of the DMV or not, is there any way for me to verify that I can actually have this removed in June?
