How much of a chance do I have of winning a DUI case that was withdrawn due to lack of evidence?
I was stopped at a DUI checkpoint in San Clemente. I have an attorney that went to trial for me and he had the case withdrawn due to the lack of reports from the DUI checkpoint. They have 1 year from the date of the trial to re-file the case and produce the missing evidence. My question is: Has anyone had a similar experience and if so, what percentage of the cases were dismissed or what percentage of the time do they fail to produce the evidence? Hi there, Unfortunately I was just charged with my 3rd DUI within 10 years and I was about 10 days from being off of informal probation. I was not clearly explained the consequences of not submitted to a Preliminary Alcohol Screen and I refused. I did submit to chemical at the station. When I received my temporary license I noticed that they checked the PAS refusal box and there seems to be additional consequences for this. My questions are: 1. Does the probation or PAS refusal preclude me taking advantage of getting an IID and ending my revocation early? 2. If I am eligible for the IID, is it 6 months after the revocation starts or 6 months after I am convicted? Thank you for your help!

I work as a therapist in a PT rehab with geriatrics and my past convictions have nothing to do with my job. So I received my dui and I blew a .13. This is my first time offense and since I said no to the blood test, the police report said I refused trombetta. I've been doing some research and I've read that my license can be suspended for a year. I'm really hoping that it doesn't get suspended!
