"CASE CLOSED" --What, why, and how???
Convicted of a DUI in 2009, in Alameda County, California.I was sentenced to one day's community service, DUI School, and a fine of $1700. Paid fine. Did not complete the school, and I did not show for the assigned community service work date. Bench warrant issued 9/2009. Today I called criminal clerk, he pulled my file. He told me that the warrant had been recalled (July 2014) and the case was closed. Come fill out papers. WHAT DOES THIS MEAN??? I was originally calling the courthouse to make arrangements to turn myself in.
I'd contact an attorney in Alameda County. It's odd that the warrant was recalled if you never appeared.
DUI arrest while working in the US during gap year from the UK
I'm from the UK and was arrested in Napa, CA this weekend for DUI. There was no accident and there were no injuries. I have had my employment terminated and therefore have no income or savings. My visa still has time to run but with no money and likely nowhere to stay longer than a week or so (I'm currently staying in accommodation linked to my employment) the best option for me is to go home to the UK. I can arrange a flight. I don't want to leave the US without resolving this. I may wish to come back in the future and understand the this would likely not be possible should I leave before this is resolved. I don't have the police record at this stage so am not sure what the breath/blood test results were. I've booked some free consultations but am not sure what more to do. Please help!
Sorry to hear about this and my apologies for the lack of international hospitality demonstrated by the police in Napa....
Will a 1650 waiver packet to get license in another state work with an active bench warrant.
When I was younger I made some bad choices. I have a misd. bench warrant in CA for not completing 2nd DUI probation. I now live in rural Idaho. After a rough start in life and battling alcoholism, my life is in order and Im a married proud parent of two children. I will handle the warrant, but saving the money has been difficult. I was honest with CA DMV mandatory action and they said I only have a FTP and if I pay my court fines they will lift the hold on the national registry with a 1650 waiver packet. Then I can get a job (warrant might make it hard but I'll find something) and save faster. My question is will a 1650 waiver packet work for somebody who has a misdemeanor bench warrant? CA DMV said the only hold is FTP. Thank you for your advice, I really appreciate it.
The 1650 waiver packet is only for lifting DMV holds related to the failure to complete a DMV-approved alcohol program,...
Turning myself in with 2 bench warrants for not completing 2nd DUI probation in Napa County. Do I need a lawyer?
I have a hit and run (scraped a vehicle in parking lot) and 2 DUI's (high BAL). Did my jail time for 2nd DUI and some probation requirements. I was in an abusive relationship (documented through police and SAVS of Napa) and had nowhere else to live/no job. Talked to probation and they suggested the homeless shelter. I left Napa in 2011 and stayed with a friend who was very ill to get away from my ex. I helped her in exchange for room and board. I met my husband and moved out of state and had our children. I am a recovering alcoholic, have changed my life and have people who will write letters & proof of therapy. I am hoping to get this transferred to Idaho. If I pay all fines, what are the chances they will transfer it? Can they force me to move back to Napa? I want to be with my children

Is it possible to obtain my restricted license in the same state but different county without having to do any extra paper work?
i got my 2nd DUI at Napa valley in CA on Nov. 17th, 2013, however, i will be graduating from CIA in May 22nd, and will be having a job at Google back down in Southern California in Irvine location. I have no way of getting to the DMB or to enroll for 18months classes yet, so is it possible to issue my restricted license back down in irvine in California DMV wihtout notifying them or do i have to ask the DMV to transfer it for me? moreover, i heard that court cases work independently from DMV, therefore, i still have not received any charges from the court but got charged from the DMV, therefore, i sitll have not received any charges from the court but got charged from the DMV`s, would they not issue my restricted license by any means because i have not been fully charged for 2nd dui?
Napa County has one year to file charges, assuming this is a misdemeanor DUI, charges may still be filed against you...
License revoked in November by Ca. DMV. court charges dropped, no charge for violating probation. But license suspended 1 year.
My son got a DUI 4 years ago, before he was 21, he received 5 years probation. He was charged with second DUI by an over zealous forestry ranger. Charges were dropped by court and no probation violation was ever charge by the court. DVM still suspended license for a year. Lawyer at the time missed filing an appeal. He has a chance at really good job (no driving involved) but they cant hire him without the valid license, due to insurance. Is there anything that can be done? This doesn't seem fair, and DMV has way to much power. DMV has been called many times and they won't even consider a new hearing. They make it very hard to get your life back after a mistake. Is there any recourse?
If he had a hearing and lost his remedy would have been an appeal. Of course DMV wont give you a new hearing. If you...
