How much time will I have to spend in prison on revocation of probation on 3rd degree felony dwi.
I was put on probation over 3 years ago and this is my second revocation. I was reinstated cause I paid all my back fines probation fees and so on and then I couldn't stand my probation officer when I moved and basically said to heck with it. So they're revoking me again I was sentenced 5 years probated for 5 years and I also did 6 months in a correctional rehab and spent about 3 months in county. I have no new charge so I'm wondering are they gonna give me the full 5 years after I done paid all this money and did all this probation. Can they do that. I'm just like I should have just went then. Don't really seem to me like I'm a threat to people I don't even drink .
You were sentenced to 5 years, so it would be entirely logical to assume that your sentence would be imposed if you get...
Can they prosecute a DWI case without the Police Vidio?
I was charged with DWI on December 2014. Finally I had hearing. They presented me with a very high blood alcohol level. They also told me that the the Camera was not working at the time of arrest. Knowing that i was not really that drunk, can they prosecute me W/O the Video?
There have been DWI prosecutions long before the existence of police dash cams.
How do I get proof that I was not charged for a DUI?
on an armed forces base and detained while underage drinking(at the time) and dui. I however, did not go to trial or courts martial. Is there a way to get any sort of proof that I was just detained and not charged? I should add, I was a part of the military and stationed on said base at the time of the incident.
I can't think of one. If an employer would try to look, nothing should show up. Your local police agencies may find a...
In mid-2012, I received a conviction for DUI. My license, as per the court, was suspended for 1 year. DPS never received notice of the conviction, and my license never showed up as suspended. Three years later now, I am wondering about the surcharge which also wasn't assessed. The Texas statute says: Sec. 708.102(b) Each year the department shall assess a surcharge on the license of each person who during the preceding 36-month period has been finally convicted of an offense relating to the operating of a motor vehicle while intoxicated. Sec. 708.102(d)A surcharge under this section for the same conviction may not be assessed in more than three years. Will the surcharge automatically expire this year, so that it can never be assessed as it passed out of the three year time frame?
Check your license and all the applicable surcharges and other actions on DPS website. It will tell you what is...
Will the DWI arrest be included in the non-disclosure order after completing a deferred sentence for obstruction of highway?
I am likely to receive an offer to reduce a DWI charge to obstruction of highway with deferred adjudication, and will need to make the decision I assume all face between accepting the offer and taking my case to trial. However, I wanted to confirm that upon successful completion of the probation term and the passage of the two-year waiting period, I can file for an order of non-disclosure that will seal both the DWI arrest and the sentence on the obstruction charge. Since the deferred was not granted on the DWI charge (as is not allowed), but instead the second obstruction charge, does that make the record of the DWI arrest itself ineligible for inclusion in the order of non-disclosure? Thank you.
This is squarely in the realm of legal advice, and we cannot give you legal advice without fully understanding the...
I was on Parole for one year when i picked up a dui. I am waiting for my parole to expire to turn myself in
I havent spoken with an attorney last one wanted 10 gs he is now the D.A..shouldve gone with him, am I wrong to think that my parole will expire and i can deal with my misdemeanor, I am on the Lam right now n have been for 4 years and not once have they gone looking for me.
I would speak to your parole officer now, rather than later. Your delay in reporting will not solve the parole issue....
First DWI/DUI in Texas and require SR22 for 2 years ...Moving to Pennsylvania and doesn't require SR22 ?! What should i do ?
FYI ONLY 8 states don't require a SR-22 (Delaware, Kentucky, Minnesota, New Mexico, Oklahoma, Pennsylvania, New York, and North Carolina) after a DWI/DUI.
I think you ought to make sure your Texas license is in good stead before applying for a PA license. So get the SR-22...
