Should I accept this deal? Second opinions please.
OWI in Rochester Hills, MI 52-3. I have a very good lawyer, but like getting treatment advice from a doctor, I am curious to hear a second professional opinion. Stopped for speeding. Officer claimed to smell alcohol I refused to answer any questions, refused field sobriety tests, refused field breathalyzer. Arrested and refused breathalyzer at station (Licensed out of state and the arresting officer did not file refusal paperwork in time with SOS so that is not an issue). Blood test came back .06. Plea offer is for careless driving plus underlying offenses (speeding 41/25, invalid proof of insurance/registration, C/I field breathalyzer refusal). Also I have to make a statement in court that the police had probable cause to arrest me (they are concerned I could file a civil suit for wrongful arrest because my arrest was highly subjective). My attorney is pleased with deal as trial would be a roll of the dice. I just want to feel good about my decision to accept because my original goal was to have OWI dropped all together.

When I was 17 i caught a dui. I'm now 35 and being charged with 2nd dui. Is this possible?
I had a felony child support warrant. Got pulled over. I was drunk. They got me for dui. Took me to jail in Oakland county. They said they would release me in the morning if Livingston county wouldn't come get me. Livingston county came. Never got a dui ticket or nothing. Went to court for child support. Got sentenced to 10 months prison. Got to prison. Wrote the city about taking care of the dui while I was in prison. They wrote back and said no, ill have to come in to take care of that. So a warrant was issued. Got released from prison. They run a check on you there they let me go from prison. Violated parole. Next city over from the city who issued the warrant parole officer called the city and asked if they wanted me. 'Advise and release' they said. Went to treatment. Got released from treatment. Ran a lean on me. didn't want me. Got off parole. Ran a lean again. didn't want me. About a month later got pulled over driving. Next city over from the warrant issuing city. 'Advise and release' they say again. I guess my question is 1 can they hit me with dui 2nd? My first was when I was 17. I'm now 35. And 2. Can't I get it dropped? They have had MANY opportucities to pick me up

Violated bond for DUI, didn't wake up to breathalyze. Am I going to jail?
Hi, About a week ago, I woke up at about 11am, in a panic because I was late for work. I was also supposed to breathalyze between 5-7AM. I thought I blew when I woke up (3 hours after), but according to their documents, nothing was recorded at all. I have been experiencing a lot of anxiety and didn't sleep for approx 48-72 hours prior to that. I called my boss who knows the situation and she told me to go to the DR to get treated for insomnia. If I bring paperwork stating that I was treated for insomnia on that day, and my boss writes a letter explaining that she knew about me not sleeping days prior, (I must have straight up passed out late Wed night, early Thurs morning) do you think this is a plausible case against my missed test? I'm terrified of going to jail, if so then I won't be able to return to school due to my situation, and I also miss my mothers wedding which is the weekend of the bond violation hearing. Last winter, we were hit with an ice storm here in Michigan. My mom was on her way home from the grocery store beginning of the storm (3pm), hit a patch of ice and slid off the road and into a very small tree, at a low speed. There was no damage to anything except her OLD car, which the insurance company totaled (it was too old). However, the police decided to arrest her because he asked her if she had anything to drink. Of course she hadn't, but she had taken a Norco, as prescribed by her doctor. My mother has a previously broken back, so shopping is hard for her. Drug test came back - she had nanograms of Norco in her system, along with nanograms of Xanax from the previous night, which she also has a prescription for. My dad has been taking her to court, but now they are talking to me about probation! I asked if she was convicted of a DUI and both say "I don't know what happened". Neither seem to know what the judge did!!! Is this normal to get a DUI for small traces of Norco and Xanax in your blood, even with a script? And is it malpractice by the court-appointed attorney? They don't know what's going on! No previous criminal history. Thank you!

I currently live in Arizona but on probation in Michigan. I had one violation (positive breath test, but the others were all negative) of my probation and my P.O. violated me. I now have a court date set in two weeks back in Michigan. I will not be able to make the date (financial reasons) and I'm sure their will be a warrant put out for my arrest. How can I avoid jail time for violation of probation?
I was recently back in Michigan handling a warrant issue for a DUI and 2nd offense Driving on License Suspension in Rochester Hills. My judge was Asadoorian. She sentenced me to 18 months probation; once my other stipulations was completed she allowed me to move back to where I'm currently living in AZ. I still had to do breathalyzer test while in AZ and blew .000 everytime since my arrival back until Yesterday where I blew .03; My probation officer decided to violate me for this one mistake, due to me being ill and taking a lot of medicine. I would like to avoid in jail time and return to AZ if possible; I am currently working (two jobs) and in school. I also already served a 21 day sentence for a bond violation while in Michigan.
