Can multiple DUIs be sealed/expunged?
Between 1990 and 1999, I pleaded "no contest" to three DUI's (two in Ohio and one in Virginia). Each was a misdemeanor. I complied with all fines and courts' sentencing. These are now affecting life insurance rates and I would like to not have to report them. I was a different person and it was a different time. Are these going to continue to haunt me for the rest of my life?
DUI's can not be expunged under Ohio law. You would need to consult with a Virginia attorney to determine if your...
I feel that for some reason a female state highway patrol officer has some personal issue with me.
She gave me a DUI ticket when there was no reasonable sign of drug use. She asked me what medications I was on (before reading me my miranda rights) and i told her I took adderal (among other medications) and it was by perscription. She said is that your story ? Do you want to change that? The drug test has come back with amphetamines (of course) and she called me at 1:00 in the morning to say "the lie is over" your license is suspended as of today. It's seems to me that the court has to make that decision, no? So I ran over and got my list of medications to send to the public defender, and faxed and emailed them today. (no reply yet) She also grabbed my balls when she was searching me. I was wondering if I have grounds to file charges for false arrest? I wasn't hired for a job because of her
The short answer to your question is "Yes" you can be charged with a DUI/OVI taking prescription medication. That said,...
I so I know I was drinking the night before?
So I know I was drinking the night before and I've had an Interlock system on my car for nine months and on that 9th month I failed one interlock car start test so I did not think anything of it went in for the 10 month check up and they saw that I had a positive test so I told them the truth I said hey I was drinking the night before and woke up in the morning brush my teeth and went out to my car to go start it and I feel that it wouldn't start so I roll down the windows wet inside drink a glass of water and a half hour later I tried it again and it start just fine so yesterday I got a letter in the mail saying that they are going to extend my suspension of my license an additional four months for one test that I failed and I'm not on probation anymore any suggestions out there?
You cant fail any tests. Don't start the car with any alcohol in your system

Is there any chance of getting a license suspension under 6 months for a first OVI?
I was pulled over for speeding "47 in a 35" and they smelled alcohol on me and gave me sobriety tests. I failed and was arrested, but was not booked into jail. I had to fill out paperwork, blew a .169 which is considered a "low OVI" and then called a ride to get me. I have no prior OVI's, and no other criminal or traffic violations on my record. I am a single mother, with 2 jobs, and we are involved in a lot of activities so losing my license has been very detrimental. What are my most likely outcomes?
Since you are on the higher end of "low tier" ( 0.17 is a high tier ), your case may be difficult to bargain down. But,...
Can someone be fired for the same thing they were let go for the previous year?
My son was fired for failing a drug test, which they would not show proof that he failed and he was never contacted by the company doing the drug test to see if he was on any medication (which I thought by law had to happen before they contacted the employer), in April 2016, rehired July 2016 and then terminated again in January/February 2017 for the same drug test he supposedly failed in 2016 after passing drug test, background check and company questionnaire for his conversion in 2017. Work I. Kentucky live in Ohio
This is not really a DUI question, but an employment question. Ohio is an employment at will state and people can be...
When I go to court at any given time should I have the option to have legal representation?
I'm on probation I also attend a day reporting class and IOP class where I failed a drug test and was scheduled for court the next day at court they gave me 5 hours to report to a halfway house without legal representation I did not show up it's one day after and I'm wondering if I should get a lawyer to help me fight this I've been paying on my fines and attending classes. It seems like a lot of this has been going on in Summit County if you don't know your rights they will railroad you in in through the system like a money machine
If you are facing jail time, then you have a right to counsel before the court can go forward with the hearing.
