Can i get a new york state liquor license to own a tavern if i was dishoharably discharged from the Navy via a court marshal?
I had Dirty urinalysis test positive for cocaine and had a court marshal, I served no time in prison for this the lowered my rank, fine me and processed me to be discharged. In new york does this show up as a felony on my criminal record which would prevent me from getting a liquor license to own a tavern. This happened 24 years ago I have no criminal history and have been a model citizen I am a business owner husband father and mentor. Is there a way of upgrading my discharge or expelling it from my record?

Can a judge agree to a plea bargain without the consent of the District Attorney?
First offense driver with .18 BAC. Ran off road, but no accident. Cooperative defendant. Charged with Aggravated DWI. Can a judge agree to a plea to a lesser offense (Driving While Impaired) even though the DA would only consent to standard DWI. Successfully completed a Drinking Driver Program operated by OASAS and received a positive assessment. Received a positive evaluation from a New York State Oasas approved provider for IDS Screening and Assessments.
The prosecutor has to offer a plea bargain, the judge has no power to do so on his or her own. But, a judge does have...

i just took a plea from the DA at central islip court for 1 year interim probation and pleading to a dwi. I have been told both that i will be eligible for a conditional after the dmv gets report of the conviction and i have been told that i am not because interim probation is not actually a charge. I would like to know the answer as my current attorney is impossible to get a hold of on this matter.

Refusing a blood test but took a breathalyzer
I am being charged with DWI even though I only blew a .03. I am 24 years of age so I know that is legal in my state. I was caught with heroin in my possesion so the police decided to give me a DWI just because I had the drugs in my possesion. I told the police I had partied the night before and stopped at 2 a.m. I was arrested at 10:30 the next morning. The police wanted to do a blood test but I refused since I had no lawyer present and I have no way of knowing if the test are done in a proper fasion. The officer claimed I blew a stop sign that I had stopped and waited at for about 3 minutes because of traffic. Then when I got pulled over he immediatly told me I was going to jail because I forgot my I.D. at home. I got out of the car to look for an I.D. and he stuck his hands in my pockets.
Most likely they're charging you with a "combined influence" DWI - a mixture of drugs and alcohol. The search you...
