I applied to Albamy, NY for reinstatement of my drivers license/privilege and was denied. Deemed a persistently dangerous driver
I paid all and any fines and completed all necessary programs. I even attached letter from my probation officer saying he was in agreement that I had met all requirements so that I could have revocation lifted. Sections 136.5(a)(3) and 136.5(b)(2) were cited in the denial as reasons for such. In summary "revocable offense" is the first section explaining that the first time I received a revocation of my license that is the date from which the second section stating that a person receiving 3 or 4 alcohol or drug related driving convictions or incidences in any combination within a 25 year period from said date of revocation then gives Commissioner the ability to deny application. My questions are, what is or should be my course of action. Can I go to another state and get a drivers licen
Another state would probably not license you, as they ask you re: prior convictions of this nature typically, and may...

Basically after i finish my revocation with the courts... can the 10 yr NY dmv band affect me moving out to Georgia to get a license?

Are there previous examples of prescriptions such as Adderall effecting field sobriety tests?
I received a DWI based on the officer's observations of a field sobriety test that included a (1) the horizontal gaze test while in the automobile, (2) a walk and turn test, (3) the horizontal gaze test outside the automobile, and (4) an onsite breathalyzer (.129). I refused the chemical test and have a refusal hearing with the DMV regarding my suspended license. Is there any examples where prescriptions such as adderall have been found to effect the outcome of either the horizontal gaze test and/or Breathalyzer?
It doesn't matter if it affects the breathalyzer since you refused it. The onsite breathalzyer you described is not...
Question about probable cause on a DWI?
I unfortunately was arrested for a DWI. I was followed late at night, by an off duty cop who was driving his own personal vehicle, a Jeep, with off road auxiliary lights on super high. He followed me all the way to my home. I felt extremely scared and didn't know who he was. He also was tailgating me extremely close. My security camera at my home captured him doing this. He apparently made a call (I don't know to whom as I never recd the reports or if there was a 911 call) and I subsequently was arrested for DWI by another cop. I wanted to find out if this would still constitute probable cause? He claimed that I was driving erratic, which I was definitely was because I was frightened out of my mind. I am female and live alone. He never identified himself so I was terrified. Thank you.
i would have to read the complaint. If it says that the arresting officer was informed by the other off duty cop that...

Husband has a DWI accident n my name is Not on the registration but IS on the car insurance can I be sued?
I want to clarify my prior question from this morning. My concern is that my husband will get into a car accident for DWI n be sued but because both our names is on the House Deed and Car Insurance and Savings Account that I can be sued too. My name is NOT on the car registration, does that make a difference? Before something like this happens, is there a Legal Document I can have him sign releasing me from any responsibility for his actions?
Best bet is to get a big insurance policy, and look into an umbrella policy.
