I'm on probation for a DUI and failed my blow in the morning and now I've been summoned. What likely will happen?
This is my first dui and my probation stated that I'm not supposed to consume alcohol during this period of probation. I had some drinks at night and woke up to go to work and failed my blow test so I turned off my car and left it. This happened two separate times. Ive been summoned for a court hearing. What is the most common consequence for this violation? If jail time is needed, can I get work release during the days I'm serving? I'm afraid a public defender won't help much in this matter and not sure if a hired attorney would be able to do much either. Please help
It is hard to say what the court will do without knowing more about the judge in particular. What I suggest you do is...
I'm a 1st time dui offender and i failed 3 blows on my interlock. i got a court notice and am wondering what likely will happen
this is my first time for a dui
Without knowing the reason for the failure it's tough to say. If you were drinking, there is a strong possibility you...
Can the treatment portion of my DUI deferment be done at any time?
I have been offered a job out of state. It will only be for a few months, and due to my family's financial situation, I can't pass it up. I have been trying to get help from my public defender for months now, only to find out he's been fired. Nobody at the district court seems to return my calls, or give me any information other than I'll be assigned a new defender. In the meantime, I am only about half way through with my initial phase of treatment (72 hours of classes in 12 weeks). I don't want to just bail on my responsibilities, but what do I need to do? I know there are AA meetings where I'll be going, I have the IID and am paying my fines like I am supposed to. Can I postpone treatment until I get back?
You'll have to get permission fro the court. You'll likely need to hire a private attorney to help you or ask to speak...
Pulled over for "speeding", though I wasnt. Arrested for dui and never cited for speeding, illegal stop and search?
Pulled over for speeding 1/4 mile from hotel, I was complying all traffic laws and was not driving erratically. I just had consumed alcohol within the hr and answered truthfully and I questioned the speeding. I wass detained on road for 40 minutes, given a field sobriety test on a hill which made balance rough then eventually a breathalyzer which 40 mins after stop was .12. I feel everything should be thrown out because I was not cited nor any evidence given to reason for initial stop thus violating my 4th amendment rights.
You need to hire an attorney to represent you. The officer may have stopped you for speeding and smelled alcohol and...
Can I still tell the truth to save myself from the consequences?
A few months ago a "friend" and I were party hopping. He was driving and I was the passenger. He was driving pretty fast and told him to slow down but he didn't and I seen that the road curved but he was still going straight so I grabbed ( I didn't yank the wheel) the wheel to steer away from going off the road but then he grabbed it steered the other way and we crashed into a fence. Long story short the police showed up and I took the blame cause he was really hammered and I had about 2 40z. I was trying to look out for him since it would have been his 3dui and now because I took the blame that I was driving this is my 2nd. So my question is if I were to tell the officials/judge the truth would I get in even more trouble or would it go away? I know I should have never tooken the blame.
First problem is that the police or judge might not believe you. Best bet is get a good lawyer and tell him everything....
I have an initial court appearance for a DUI in Washington state and I am not sure what to expect?
I was arrested on a DUI charge on Saturday morning and with the weekend and holiday on Monday, have not seen a judge. I have my first court appearance tomorrow and don't know what to expect? If I will have to enter a plea, etc.? It was my first ever offense for DUI, and again, with the weekend and holiday all the local lawyers are not taking calls. I would just like to know some of the initial proceedings until I can talk with a local DUI lawyer.
Some of us local attorneys are working today. Your first appearance will be your arraignment where you enter your plea...
Would my only DUI, which was seven years ago, prevent me from obtaining a concealed pistol license?
I am 61 years old and went through the deferred program successfully.
If you completed the deferred program successfully, this means your charge was dismissed or no filed. With this said,...
