DWI reduced
I blew a .11 at a checkpoint I have a perfect driving record and have never got in trouble. I did get a lawyer for 2500$ and I don't think he is really trying to get this reduced. He stated that it would merely be a favor he would ask of the judge because he knows him. I have went to counseling she stated that I do not abuse alcohol and talked to the director of ASAP she stated that I should wait because its 450$ no money back and if I get it reduced I may not have to do the class at all... Also the officer said I was extremely polite... Not sure what to do I don't have the 450 to spend on the class but really need this reduced... What should I do and Is it really that unlikely that it wont get reduced?
You should talk to your attorney - I know that a .11 would be very difficult to get reduced in our jurisdiction but...

This is my last ditch effort to clear my DUI. I have already been convicted. However, I have read of several instances online that because alcohol takes 20-30 minutes to effect you, that if you were stopped within approx. 5 minutes from your last drink, that the stop itself may actually put you at Driving under the Influence. If you can testify you drank something right before leaving the bar, and that if you had driven home without being stopped, you would not have been affected while actually driving. Is this true, and/or is it a valid defense? Thank you in advance for any legal advice.

Legal Liability DUI - post separation
My wife's a drunk. She hasnt had a DUI yet, but drinks and drives all the time. I used to take her keys away and lock them in the safe on a regular basis while we were together. During the 6 years we were together I think she was hospitalized for falling down the stairs twice and for alcohol detox with DTs 3 times (Or something like that, I lost count). Now that we're getting separated and I've found a place to stay, I kept her keys because I feel that I would still be liable if I let her drive. Is that correct? Can I address this in a separation agreement or do we need to re-title the cars and re-do the loan first? What if she gets a rental car on her own credit card?

Hello, I am currently on a 6 month probation term due to a Theft of Government Property charge. I have been on probation for about 3 months now and unfortunately I have been having some problems passing the drug test. I admitted that I smoked marijuana regularly when I first started probation which would cause me to fail the first test. I ended up failing my second test after that, and now this morning my Probation Officer left me a voicemail letting me know that I have failed the third test now. I have been attending Substance Group Therapy once a week for the past month, along with going to AA/NA meetings (as required). I am in need of serious legal advice before talking with my PO today and moving forward, since I am almost positive now he will be violating me. I am trying to figure out my options of what I need to do now to have the best possible outcome for this situation. (besides staying away from the substance) Is it better to admit to your PO if you had a slip up and that's why you failed? Or is it better to keep denying any use? Can I get a driver's license in Washington state if my license is suspended in Virginia?
My driver's license has been suspended for 10 years through the courthouse in my town in Virginia due to court fines (some are traffic-related that was the reason for my suspension but the suspensions were only for 6 months and those are over with but) the court has suspended my driver's license because I have not been able to pay for my court fines which is stupid... why suspend ones driver's license so they're unable to get a job and drive to work or drive a company vehicle etc. so that way it would prevent them from making money to pay their fines... So anyway... I owe around $2,500 at the courthouse Plus I will have to pay a $500 uninsured motorist fee plus reinstatement fee which would be $650 total. that is here in the state of Virginia and it is almost $5,000 that I would need that would include court fines DMV fines and then getting my vehicles prepaired for inspection (they have been sitting for a great deal of time...) and insured and tagged etc. So I am living here in Virginia with a suspended driver's license and a felony record that prevents me from being able to work and support my family I want to move to Washington State to start all over again, what to do?
Get a clear license. whether stupid or not until you get a license the other state will not issue you one.
