I took a plea deal in a DUI case even though I was under the .08 legal limit.
Even though I did nothing more than hesitate at a red light the officer charged me with DUI He went on to charge me with four felony counts of child endangerment because my teenage children were in the car. Again I was under the legal limit. I was not speeding, crossing lines or in an accident. I believe the officer did this after I passed the breathalyzer test to ensure that he would ultimately win in court. Even though I hired what I thought was competent legal services, the lawyer ultimately got spooked by the JDR PA. She threatned to go after me on the child endangerment charges with jail time if I did not accept the plea of reduced DUI to Reckless Driving but I still have to go to ASAP and get interlock. I have a very good record but this was a second charge of DUI within. I was charged 8 years ago because I refused the breathalyzer test in the field. I believe the officer ran my plates before he pulled me over With the plea deal she was suppose to dismiss the child endangerment charges but instead Nolle Processed the charges which I know is different. What can I do and what agency should I file a formal complaint with? Attorney General's office? Bar Association?

I have a Lifesafer lock on my truck on December 2014 I blew a fail and called my VSAP as soon as I did and told them what I drank and how much. As a result I had to restart my 6mth monitoring over and pay VSAP $50 a month and $80 montly for the device what a pain but it was my fault. I work from home and we had had a lot of snow and ice and hadn't started my truck for 2 wks till 2/18/2015 at 11am I had not been drinking I blew a fail I turned truck off and did what the paper said if false positive went back blew a warning but was able to start truck i assumed it just needed to warm up while waiting it signaled to blow again and it failed with truck running this happened all within 1 hr. Waited for VSAP to get back from lunch to tell them what happened tried again at 1:20pm an it passed.
No way to know without getting and overlooking all the evidences surrounding this issue.

I would like to know what are the consequences of testing postive at the ASAP class? From what I understand is that I have to go in front of the judge who will then decide my punishment.
What will happen and what will be done?. I have a clean record and this was my first DUI conviction ever in my life. I sincerely would like another chance to complete the ASAP class. Would this be a possibility or am I facing jail time?

Can I get a restricted license after a felony DWI?
In 2014 I was involved in a DWI. Another car crossed over the center line, I swerved to avoid it, and injured a pedestrian. There was alcohol in my system. This was my first offense - both traffic and criminal.
My lawyer had me plead guilty. I lost my license for 4 years, have been on probabtion for two (with zero issues), paid off all court fines as well as a substantial restitution to the victim.
The accident occurred in NC but by the court date I had moved to VA. I have no family in the area and no close friends in town. My boyfriend, the reason I moved to VA, is slated to deploy in the next year. Is there a way I can petition for a restricted or hardship license so that I can maintain the house, go to doctor's appointments, care for my animals, etc. while he is out of the country? Better yet, is there any way I could potentially get an actual license back before the originally assigned 4 years is over?
