I got arrested under DUI while I pulled over my car and calling AAA at night--bad timing CHP showed up and had me field test and CHP thought I rejected breath test. --No one witnessed my driving. --I only had a glass of wine a couple hours ago.( A month later DMV sent me order of set aside and I got driver license back already as I assume my BAC was .02 or so by iphone APP BAC cal but DMV didn't disclose my BAC result) --CHP report says, I had red eyes ( I had dry eyes and proof of receipts of eye drops prior to arrest also email evidence I was telling my friend of my eye problem) -- CHP report says I spoke slur ( English is my 2nd language and it was close to midnight and I was tired) I am hoping DA will drop the case. I believe my case will be dismissed in the court even convicted.
Sounds like the case may actually not be filed based on what you said here.
When asked if ever convicted of a crime, can one just put Reckless Driving since that is what VC 23103 technically is on DMV website/CA Law?
If you were convicted of a VC 23103, and your VC 23152 charges were dismissed, then yes, you would write "VC 23103"...
I recieved my second dui a few weeks ago. i blew a .34 and was taken in. They kept me 2 days and released me. I went to my first court apearance yesterday and was arrested. My bail was set at $7500. My charges are VC 23152 (A) and VC 23152 (B). My next apperarance is in less than a week for a pre trial and i am not sure if i will be appointed a lawyer or if i should get my own. I do not want to face jail time and am looking to move out of state asap. How easy will this be to transfer to Iowa? What Penalties am I looking at? My first DUI was in september 2007.

I had filled forms CR 180-181 last month and the petition was granted. Case was dismissed. Now I've found out that my name still appears in the website and accessible to public. I have called the court several times, asking if I can seal the record. They have kept telling me that nothing I can do, that the case will be stay there forever. I have googled search; some people have stated that I can seal the DUI case, that they will destroy photos, finger prints etc. Is this true? Have any of you done this before in CA and if you can share with me, what should I do? Can I do this myself? or should I not worried about this, probably it will drop within 10 years like the record in DMV? Thank you.

Arrested in Nov. by CHP for a DUI in San Mateo Co. 1st offense, blood came back .20, arraignment in Feb. While I don't think I qualify for a public defender (salary over $25k/year), money is still incredibly tight so I have not retained an attorney. Have already begun taking DUI classes, AA meetings signed off, all as part of what would only be a plea to the judge/DA for sympathy. I've already accepted I'll get the max fine, 9 months of class, lose license, etc.; I'm prepared for this, but only thing I'd have to fight back against is actual jail time, which would cost me my job. 15 days on the Sheriff work program on weekend is no prob, but I just can't vacate my work. I know this is your livelihood so saying so might hurt your profession, but do I truly need a lawyer just to avoid jail?

I paid fines, surcharges, and went through their classroom sessions. I called NJ DMV and they said i dont owe NJ anything anymore. I am clean. My license was restored in 2010 (after 3 months). If I go to CA DMV would i face any issues?

He went to court now in March 2012 because he had a warrant and in court they gave five months + 75 days to he will like workfurlog. He is trying to fix their immigration papers and this case had it yet, but the day that he surrendered not workfurlog allowed to make, and he was arrested and given 150 days, my question is if he can ask for a reduction of days because you did not get 50% they gave only 15% as you are counting as if he on workfurlog be doing on at this point is he had 70 days in jail already. We are about to lose our house because he is the main support of the family and we were not prepared for this situation
