Can Bob claim he was voluntary intoxicated if he went to court or would he be charged with disorderly conduct?
Bob and Jon are walking home from a hard night of partying at a local drinking establishment. bob is very intoxicated, swaying as he walks, and Jon isn't much better off. As they walk home, they pass Mike coming the other way- Mike is a gamer and wears gamer association t-shirts. Bob and Jon both find this entertaining, and Bob begins openly mocking Mike about his t-shirt. Mike takes offense to this, shouts at the two to leave him alone and attempts to walk past the two with his hands in his pockets. Jon shouts "hit him, Bob" and Bob strikes Mike in the nose with a closed fist, breaking Mike nose. Bob and Jon stand there congratulating each other drunkenly.

Can handheld breathalyzers be used as evidence to convict me of an underage drinking ticket in Vermont?
I blew a 0.03 and denied drinking any alcohol. If I go to court, do I have a chance at fighting it because they didn't do a calibrated breathalyzer at the station? I read handheld devices aren't accurate enough to be admissible in court.
Most states do not allow these tests to be admitted. You will need a VT lawyer to confirm this is the case there....

I was "stopped" (though I wasnt driving. I was actually sleeping in my vehicle with the engine running) and was checked on by a passing officer. When she woke me up she decided to put me through the SFSTs. Im not sure how I did on the HGN but I personally feel I did well with the walk and turn and one leg stand. She proceeded with the PBT but could not get it to work roadside so she took me into custody and brought me back to her barracks. After waiting a little while her PBT started to work and I gave my breath sample followed by my DMT sample. I blew a .15. Can someone help me please? Do I possibly stand a chance at winning my case? My boyfriend is on probation for dwi and he got arrested on a warrant for domestic assault, he willingly turned himself in to his po. He was arraigned and bail was set and he had conditions he report to his po as soon as he's bailed out and that he have no contact with the victim. But when I went to bail him out they said he couldn't be bailed out cuz he violated his probation. I'm very confused and don't understand why the judge set bail and gave him conditions of release if he can't be bailed out??
Because no one has set the bail amount on the violation as of yet. He should speak to his counsel.
Caught underage drinking but no citation given -- what next?
So I was at a high school graduation party and was caught drinking by the police. I gave them my name and date of birth and took a breathalyzer test (blew a 0.079). The officers said that I could go through the court diversion process and they would give me paperwork before I left. They stayed with me until my ride came, but they never gave me any paperwork or said what they were going to do with me. Now I'm wondering what to do next; should I do nothing and wait or is there a way to find out if I have a citation/am in trouble? Thanks
